State Legislation for PRISM

States must make sure that, according to their own State statutes, they have the legal authority to apply PRISM vehicle registration sanctions.

In some States, the authority for law enforcement to retrieve vehicle registration plates/tags from carriers who have received PRISM registration sanctions must be procured separately. Each state must decide the legality of this issue based on individual state statutes and seek legislative authority or change administrative rules to retrieve plates if it is necessary. For States seeking examples of model legislation in these areas, referrals can be provided; States can contact the FMCSA Division office in their State or e-mail PRISM Technical Support at PRISMTechnicalSupport@dot.gov or e-mail the PRISM Program Technical Manager, Stephen Parker, at stephen.parker@dot.gov.
