The Assistant Administrator, who is also the Chief Safety Officer, of the Federal Motor Carrier Safety Administration (FMCSA) serves as the final agency "decisionmaker" in civil penalty enforcement proceedings under the Federal Motor Carrier Safety Regulations (FMCSRs), the Federal Hazardous Materials Regulations (HMRs), and the Federal Motor Carrier Commercial Regulations (FMCCRs) in accordance with Federal regulation 49 CFR 386.1. The Assistant Administrator also serves as the final agency "decisionmaker" in all safety rating appeal in accordance with Federal Regulation 49 CFR 385.15 and in all hazardous materials safety permit appeals under Federal regulation 49 CFR 385.423.
