CPSC Business Portal

The Database is the Publicly Available Consumer Product Safety Information Database located on SaferProducts.gov. The law requires CPSC to maintain this Database on the safety of consumer products and other products or substances regulated by CPSC. Submitters can file Reports about a harm or risk of harm related to the use of a consumer product or other product or substance within the jurisdiction of CPSC. The Database is required to be publicly available, searchable, and accessible through the Internet.

Beginning on March 11, 2011, Reports that contain minimum information required by law are eligible to be posted in the Database. Anyone can search SaferProducts.gov for safety information about products they own or may be thinking about buying.

Product manufacturers (including importers) and private labelers that are identified in a Report may submit comments to be displayed on SaferProducts.gov along with the Report. Information about product recalls is also available for search and review. SaferProducts.gov represents a new level of transparency for CPSC, allowing the public to have easy access to safety information about consumer products.

The Commission does not guarantee the accuracy, completeness, or adequacy of the contents of SaferProducts.gov, particularly with respect to information submitted by people outside CPSC.

A Report is any information submitted to CPSC about a harm or risk of harm related to the use of a consumer product or other product or substance within CPSC’s jurisdiction.

Section 6A of the Consumer Product Safety Act (CPSA) requires us to provide Reports to manufacturers (including importers) and private labelers identified in a Report when the Report meets the minimum requirements for publication on SaferProducts.gov.

You are not required to take any action regarding a Report. However, you may take one or more of the following actions for each Report at any time through the Business Portal on SaferProducts.gov:

• Submit a General Comment (see 16 CFR § 1102.12 for requirement details);
• Make a claim that the Report contains confidential information, meaning information that contains or relates to a trade secret or other matter referred to in 18 U.S.C. 1905 or that is subject to 5 U.S.C. 552(b)(4 ) (16 CFR § 1102.24 for requirement details);
• Make a claim that the Report contains materially inaccurate information, meaning information that is false or misleading, and which is so substantial and important as to affect a reasonable consumer’s decision making about the product (see 16 CFR 1102.26. for requirement details).

Reports that meet the minimum requirements for publication will be posted on SaferProducts.gov 10 business days after they are sent to you.

• You would like your comment to appear on SaferProducts.gov at the same time as the Report, or
• You would like a claim of confidential or materially inaccurate information to be reviewed, and possibly determined, by CPSC before a Report is published on SaferProducts.gov.

• Make a determination on the claim before posting the Report; or
• Redact the portions of the Report claimed to be confidential until a determination on confidentiality can be made.

May I Seek Expedited Review of a Materially Inaccurate Information Claim?

Yes, you may request expedited review of a claim of materially inaccurate information if you timely submit the claim before the Report publishes, clearly mark your claim for expedited review, and limit your submission to five pages (including attachments).

Manufacturers, which includes importers, distributors, and retailers, are required to report to CPSC under Section 15(b) of the Consumer Product Safety Act (CPSA) within 24 hours of obtaining information that reasonably supports the conclusion that a product fails to comply with an applicable consumer product safety rule or with any other rule, regulation, standard, or ban under the CPSA or any other act enforced by CPSC, or contains a defect that could create a substantial risk of injury to the public or creates an unreasonable risk of serious injury or death, 15 U.S.C. 2064(b).
