Any construction that disturbs one or more acres of land is required to obtain coverage under the Texas Pollution Discharge Elimination System (TPDES) TXR150000 general permit. Land disturbance activities are defined as the exposure of soils resulting from activities such as clearing, grading, and excavating.

Small Construction Activities - Any construction activity including clearing, grading, and excavating that results in land disturbance of equal to or greater than one (1) acre of land and less than five (5) acres of land is defined as a small construction activity. This also includes the disturbance of less than one (1) acre of total land area that is part of a larger common plan of development of sale if the larger common plan will ultimately disturb equal to or greater than one (1) and less than (5) acres of land. Define the person or persons that is associated with the project, whether they are a primary operator or secondary operator.

Large Construction Activities - Any construction activity including clearing, grading, and excavating that results in land disturbance of equal to or greater than five (5) acres of land. This also includes the disturbance of less than five (5) acres of total land area that is part of a larger common plan of development or sale if the larger common plan will ultimately disturb equal to or greater than five (5) acres of land. Define the person or persons that is associated with the project, whether they are a primary operator or secondary operator.

Provide a copy of the signed/certified CSN and SWPPP to DPW-ENV at least 14 days prior to the commencement of construction activities.

Illicit discharges – The drainage, release, or disposal of pollutants in storm water and certain non-storm water from areas where soil disturbing/or construction activities are located.
