Notice of Proposed Rulemaking: Adjustment of the Amount for the Optional Rider for Proof of NVOCC Financial Responsibility for Trade with the People’s Republic of China
The Federal Maritime Commission proposes to amend its rules regarding the amount of bond coverage required in its optional China Bond Rider for Non-Vessel-Operating Common Carriers (NVOCCs). The proposed rule is intended to provide NVOCCs with the ability to post a bond with the Commission that satisfies the equivalent of 800,000 Chinese Renminbi, for which the equivalent dollar amount has fluctuated since the regulation was first adopted by the Commission. On September 3, 2010, the Federal Maritime Commission (Commission) entered an Order requiring the Transpacific Stabilization Agreement (TSA) and the Westbound Transpacific Stabilization Agreement (WTSA) to file verbatim transcripts of certain meetings. Commission Issues Order Discontinuing Proceeding on Port Restrictions and Requirements in the United States-Japan Trade
This proceeding was initiated under section 19 of the Merchant Marine Act, 46 U.S.C. § 42101 (“Section 19”), in response to apparent unfavorable conditions in the foreign oceanborne trade between the United States and Japan. On February 26, 1997, following an extensive investigation, the Commission issued a final rule finding unfavorable conditions facing U.S. ocean shipping interests in Japanese ports. See Port Restrictions and Requirements in the United States/Japan Trade, 27 S.R.R. 913 (FMC 1997) (hereinafter 1997 Final Rule).

FMC Orders Special Monitoring Requirements for Certain Global Alliance Agreements
In October 2008, demand for vessel space in the U.S. trades plunged dramatically. Vessels that had been sailing 95 percent full from Asia to the United States were soon sailing 75 percent full. U.S. exports fell by 14 percent and imports fell by 16 percent. At one point, carriers laid up more than 575 vessels worldwide, idling about 12 percent of the world’s containership fleet. By petition filed July 23, 2010, Hainan P O Shipping Co., Ltd. (“Hainan” or “Petitioner”) requested that the Federal Maritime Commission (“FMC” or “Commission”) exempt it from the first sentence of section 9(c) of the Shipping Act of 1984 (“Shipping Act” or “Act”), currently codified at 46 U.S.C. § 40703. Section 40703 provides that “[n]otwithstanding section 40501(e) of this title and except for service contracts, a rate, charge, classification, rule, or regulation of a controlled carrier may not be effective, without special permission of the Federal Maritime Commission, until the 30th day after publication.” 46 U.S.C. § 40703.
