What is Sexual Assault?
Sexual assault is a crime. The Military definition of sexual assault is: Intentional sexual contact characterized by use of force, physical threat, or abuse of authority or when a ‘crime’ victim does not or cannot consent. Sexual assault includes:
- Rape
- Forcible sodomy (oral or anal sex)
- Indecent assault (unwanted, inappropriate sexual contact or fondling)
- Attempts to commit these acts
Sexual assault can occur without regard to gender or spousal relationship or age of victim.
“Consent” shall not be deemed or construed to mean the failure by the victim to offer physical resistance. Consent is not given when a person uses force, threat of force, coercion or when the victim is asleep, incapacitated, or unconscious.

Services Provided:
- Restricted reporting where a victim of sexual assault can report an assault without automatically initiating the investigative process when calling/telling an IVA, the Sexual Assault Response Coordinator (SARC), medical personnel, and/or a Chaplain
- Advocacy and support to navigate the system to include accompaniment at court hearings, medical examinations, help with filling out and obtaining a Temporary Protection Order (TPO), a person to listen, and safety planning,
- Referrals for financial problems, psychological evaluation, therapy, follow-up medical care, support from the Rape Crisis Center of the Coastal Empire,
- Resources
- Self-Defense Training/Education
- Awareness and Prevention Training/Education
The Army Sexual Assault Prevention Program (SAPR Program) is designed to promote sensitive care for victims of sexual assault and accountability for those who commit these crimes.
THIS IS A PROGRAM ABOUT YOU, THE VICTIM, THE CHOICES YOU CHOOSE TO MAKE IN REPORTING, AND THE ONGOING SERVICES YOU CHOOSE TO HAVE.
Currently the program is designed only for Soldiers. However, the DoD and the Army are reviewing procedures for ways to extend it to others. Commanders should recognize that sexual assault affects everyone, should deal with this issue as appropriate, and keep in mind that restrictive reporting applies to Soldiers only. Family members, retirees, civilians, etc. can call the 24-hour on-call numbers and be referred for services.
Advantages of Unrestricted Reporting:
- Official investigation of the crime
- Alleged perpetrators can be brought to justice
- Command can separate victims from alleged perpetrators so they don’t have to work together
- Victims can get a Military Protection Order (MPO)/TPO
