The FOIA provides release of US Government records to the public. The US Attorney General promotes openness with the public and requires that all releasable information be processed in a timely manner. The FOIA program is governed by the Freedom of Information Act (Public Law 99-570, 5 US Code 552(B)), DOD 5400.7-R, and AR 25-55, as supplemented. A written request must be submitted under the provisions of the FOIA and the requester must be provided a response within 20 workdays. All requests for Government documents must be processed under the FOIA.
What is a record? A record is a product of data compilation, such as books, papers, maps, photographs, machine readable materials or other documentary materials, regardless of physical form or characteristics, made or received by an agency of the U.S. Government under Federal law in connection with the transaction of the public business and in DOD’s possession and control at the time the FOIA request is made.
How do I submit a FOIA request? A FOIA request must be submitted in writing. The request must be specific regarding requested documents and/or information and you must indicate a willingness to pay all search, review, and duplication costs. When submitting a FOIA request, you must allow 20 working days for processing.
