The Notice of Proposed Rulemaking (NPRM) on Head Start Transportation was published in the Federal Register on May 30, 2006. Written for Head Start grantees and delegate agencies, this Information Memorandum solicits comments from programs on the proposal that, if finalized, would offer annual waivers, under certain circumstances, of two provisions in 45 CFR part 1310. Programs can submit their comments electronically via the Internet or through the mail.

SUBJECT: Notice of Proposed Rulemaking on Head Start Transportation

INFORMATION:

The Notice of Proposed Rulemaking (NPRM) on Head Start Transportation was published in the Federal Register http://a257.g.akamaitech.net/7/257/2422/01jan20061800/edocket.access.gpo.gov/2006/E6-8222.htm on May 30, 2006.

Head Start and Early Head Start grantees and their delegates are asked to comment on the NPRM (45 CFR part 1310) which, if finalized, would offer the opportunity for annual waivers, under certain circumstances, of two provisions in the current Head Start transportation regulation (45 CFR part 1310):

  1. the requirement that each child be seated in a child restraint system while the vehicle is in motion, and
  2. the requirement that each bus have at least one bus monitor on board at all times.

It is proposed that waivers would be granted when the Head Start or Early Head Start grantee demonstrates that compliance with the requirement(s) for which the waiver is being sought will result in a significant disruption to the Head Start or Early Head Start program and that waiving the requirement(s) is in the best interest of the children involved.

It is also proposed that the definition of child restraint system be changed in the regulation. The proposed change would remove the reference to weight that currently conflicts with Federal Motor Vehicle Safety Standards (FMVSS).
