Today Energy and Commerce Committee Ranking Member Henry A. Waxman, Communications and Technology Subcommittee Ranking Member Anna G. Eshoo, and Committee Member Edward J. Markey sent a letter to their colleagues to call attention to a troubling constitutional argument being advanced as part of a case filed by Verizon to overturn the Open Internet Order adopted by the Federal Communications Commission (FCC) in 2010.  A group of distinguished former FCC and other government officials have described the issues at stake in an amicus brief to the D.C. Circuit Court of Appeals, which is available online HERE.
