Trade Adjustment Assistance for Workers Programs: Statutes

The Trade Act of 1974, P.L. 93-618, has been amended numerous times since its enactment in January 1975. Three times over the past 10 years, Trade Act amendments to chapter 2 of title II of the Trade Act (19 U.S.C. 2271 et seq.) made major changes to the Trade Adjustment Assistance for Workers program (TAA Program).  Therefore, the TAA benefits that eligible workers may apply for at their local One-Stop Career Centers depends on whether the workers are covered by the provisions of the Trade Act enacted in 2002 (the 2002 TAA Program), 2009 (the 2009 TAA Program) or 2011 (the 2011 TAA Program).  The applicable laws covering petitions, determinations, and program benefits are found below.

2002

Trade Adjustment Assistance Reform Act of 2002 (TAA Reform Act)

Applies to petitions filed:

1. Between November 4, 2002 and May 18, 2009; and

2. On or after February 15, 2011 through October 20, 2011*

*Some workers covered under these petitions may receive 2011 TAA Program benefits

The President signed into law the Trade Adjustment Assistance Reform Act of 2002 (TAA Reform Act) on August 6, 2002. It reauthorized the TAA Program through fiscal year 2007.

2009

1. Between May 18, 2009 and February 14, 2011

The President signed into law the ARRA, which contained the TGAAA, on February 17, 2009. The Omnibus Trade Act of 2011 (Public Law 111-344) extended the 2009 Amendments for six weeks.
