Prohibitions on the Possession and Use of Weapons, Destructive Devices, and Other Dangerous Items

MEMORANDUM FOR SEE DISTRIBUTION

SUBJECT:  United States Army Garrison Humphreys Policy Letter #55, Prohibitions on the Possession and Use of Weapons, Destructive Devices, and Other Dangerous Items


1.  The proponency for this policy is the Safety Office. 

2.  This policy is effective immediately.  It remains in effect until rescinded or superseded. 

3.  References.

4.  Applicability.  This policy applies to all personnel assigned or attached to, visiting, or residing within US Army Garrison Humphreys (USAG-H) installations.

5. General.  To ensure the peace and tranquility of all USAG-H installations the following rules are established.

a.  A weapon is any device, including pribately owned devices, that will eject a hard projectile by any explosive, mechanical, or compressed air means (except children’s toys which eject soft projectiles) or any device that may, by its design or manner of employment, be used to inflict death or serious injury.  The term “weapon” also includes, but is not limited to, all types of BB guns, air rifles or pistols, pellet guns, and slingshots.

b.  Personnel will not, except as required in the performance of official duties and as authorized by law or regulation, acquire, own, possess, manufacture, transport, or use any of the items listed in Enclosure 1 (Encl).  All privately owned firearms will be registered and stored IAW provisions of USFK Reg 190-16.

c. Privately owned weapons and/or firearms will not be used by persons under 18 years of age unless those persons are under the direct, personal supervision of an individual who is 21 years of age or older.

d. Toy guns that project plastic pellets will not be used by individuals who are less than 18 years of age unless they are under the direct, personal supervision of a person who is 21 years of age of older.

e. Prohibited items are listed in enclosure 1.  If approved for use, items will only be used at a facility designed for its use.  These items are subject to storage requirements IAW this policy.

6.  Sanctions.

a.  Violations of this policy by individuals subject to the Uniform Code of Military Justice (UCMJ) may constitute violations of Article 92, UCMJ, subjecting the individual to criminal punishments and administrative sanctions.

b.  Violattions of this policy by individuals not subject to the Uniform Code of Military Justice may subject the individual to administrative sanctions and civilian criminal prosecution.

c. Anything listed in enclosure 1 that is in violation of this policy letter will be confiscated and disposed of IAW applicable regulations.

7.  Responsibilities.

a.  Commanders – Ensure USFK Military personnel, the civilian components, and Family members comply with this policy.

b.  USAG-H PMO – Enforce the provisions of this policy through the use of patrols, incident reports, and/or other appropriate measures.

c. USAG-H Commander – Enforce the provisions of this policy as the misconduct action authority for violations covered by USFK Reg 600-52, Civilian Misconduct.

d. USAG-H Director of Emergency Services – Is the designated representative of the USAG-H Commander and has supervisory responsibility over the USAG-H Prohibitions on the Possession and Use of Weapons, Destructive Dvices, and Other Dangerous Items Policy.
