Reasonable Suspicion Training

Session Description: This two-hour session will cover the requirements for Supervisor Reasonable Suspicion training per 49 CFR Part 655.14 (b) (2). Those requirements include training on the physical, behavioral, and performance indicators of probable drug use, and the physical, behavioral, performance, and speech indicators of probable alcohol misuse. Certificates of completion will be provided upon session completion and will be mailed to participants.

DOT Drug and Alcohol Testing Updates

Session Description: This session will outline the role of the Office of the Secretary’s Office of Drug and Alcohol Policy and Compliance (ODAPC). In addition, this session will cover the Observed Collection Rule that went into effect August 30, 2009, as well as new DOT testing regulations that went into effect October 1, 2010 regarding the new Federal Drug Testing CCF that governs how laboratories are to report confirmed positive drug/drug metabolite quantitations to the MRO. Other current topics in relation to 49 CFR Part 40 will also be discussed.

You Can’t Fool Us! Catching the Cheaters

Session Description: October 28, 2011 marked the 20th anniversary of the Omnibus Transportation Employee Testing Act. Since the implementation of the law in 1991, illegal drug use among transportation workers has decreased and a subculture of cheaters has emerged. An entire industry has developed to assist individuals trying to beat the testing process. Employers and their Service Agents need to be aware of the ways individuals cheat and how to thwart attempts to circumvent the testing process. You will be introduced to the latest gadgets and gimmicks on the market, expose the myths associated with cheating and identify your role in ensuring the integrity of your testing program by recognizing attempts to beat the system.

DOT Testing of Breath Alcohol Measuring Devices and Ensuing Legal Challenges & EBT Demonstration
Speakers: Manny Chavez and Ed Conde
Session Description: Ed Conde will discuss the Volpe Centers testing and approval of breath alcohol devices for inclusion on the National Highway Safety Administration’s (NHTSA’s) Conforming Products Lists (CPLs) of approved devices. The method of testing and approval of Evidential Breath Testers, Screeners, and Calibrators will be discussed. The requirement to use alcohol testing devices on the CPLs and the legal ramifications for Workplace Testing and police personnel will be clarified. Manny Chavez will be performing a mock Evidential Breath Testing (EBT) device at the end of the session.

Collection Site Proficiencies

Session Description: In an effort to improve the quality of DOT urine specimen collections, this session will focus on the requirements for proficiency demonstrations that are required of each collector following their qualification training. The requirements as well as best practices will be presented. The session will also discuss common problems that have been identified and will present tools to aid monitors complete and document this critical component of the collector qualification process.

The Grantee/Contractor Relationship

Session Description: This two person-panel includes both a DAPM of a top-10 FTA grantee responsible for the oversight of numerous safety-sensitive contractors as well as a manager of a national contractor that provides services to over 100 FTA-covered grantees across the country. The dynamics, common issues, need for open communication and a solid understanding of the grantee/contractor relationship will be discussed.
