We have recently received multiple requests for the proper way to handle Termination for the Government’s convenience, as well as what costs are allowable. Well, here I go without further ado!

The termination will be IAW FAR Part 8.406-5, terminations for convenience.

Do All Team Members of a CTA Have To Be Small Businesses When Using a Small Business Set Aside?

 

Why do all members of the CTA have to be small businesses if an agency uses a small business set aside for their requirement?

It seems that Brad and I are receiving quite a few calls on this subject lately. I guess that is to be expected with the inception of discretionary set asides for the GSA schedules program as of November 2011.  Currently, the Small Business Administration (SBA) is working on developing policies in reference to set asides.

Is it true, “Once an 8(a), always an 8(a)”?

 

Have you ever heard the saying, “Once an 8(a), always an 8(a)”, or even, “once a set-aside, always a set- aside?  I have, on multiple occasions! Do you have a burning desire to know if this is true?

Well, before going any further, let me make it very clear that GSA and I are pro small business, and that a majority of GSA Schedule Contractors are small businesses.

Can I award a cost type contract and require that a contractor provide “cost and pricing data” when using GSA schedule's?

Well, obviously for those of us in the schedule program, we know the answer is NO! But COs and CSs for the most part are extremely skeptical and we want to see it in writing.  We want the black and white from the Federal Acquisition Regulation (FAR). So, here you go!

Can a cost-type contract be awarded using the GSA schedule program? No, and here is why:
