ORDER APPROVING WITHDRAWAL OF REQUEST
FOR HEARING AND CANCELING HEARING

   This matter arises under the Job Training Partnership Act (hereinafter JTPA or the Act), 29 U.S.C. § 1501, et seq., and its implementing regulations at 29 C.F.R. Part 626, et seq,, and, more specifically, 20 C.F.R. Parts 633 and 636 relating to Migrant and Seasonal Farm Worker Programs. The purpose of the JTPA, Title IV, Section 402 is to provide job training, employment opportunities and other services for those individuals who suffer chronic seasonal unemployment and underemployment in the agricultural industry.

   On June 28, 1999, Complainant filed a request for an administrative hearing, pursuant to 20 C.F.R. § 633.205(e), before the Office of Administrative Law Judges as an appeal to Respondent's denial of its Solicitation for Grant Application.

   A formal hearing in this matter is presently scheduled for November 3, 1999, in Des Moines, Iowa.

   On August 23, 1999, Complainant filed with the undersigned Administrative Law Judge a letter request withdrawing its request for an administrative hearing.

   Pursuant to an Order to Show Cause which issued on September 1, 1999, the Associate Solicitor For Employment and Training, U.S. Department of Labor, has advised that there are no objections to the Complainant's withdrawal request.

   Accordingly, Complainant's request to withdraw is hereby approved. The formal hearing presently scheduled for November 3, 1999, is hereby canceled.

   ORDERED this 7th day of October, 1999, at Metairie, Louisiana.
