ORDER GRANTING MOTION FOR WITHDRAWAL

    This matter arises under Title I of the Workforce Investment Act (WIA), 29 U.S.C. § 2801 et seq., and the regulations issued at 20 C.F.R. § 667.800 et seq.

    On August 19, 2003, the Employment and Training Administration of the United States Department of Labor (Respondent) notified Telamon Corporation (Complainant) that its application for a grant has been denied. Subsequently, on September 2, 2003, Complainant requested an administrative hearing on Respondent's decision before the Office of Administrative Law Judges (Office). On September 12, 2003, this Office issued a Notification of Receipt of Request for Hearing and Prehearing Order. Therein, the parties were instructed to submit certain information to this Office. An extension of time was granted allowing the parties an opportunity to submit Prehearing Exchange information by May 15, 2004.

    On May 14, 2004, Complainant filed a request to withdraw the appeal since the Complainant was unable to facilitate the settlement it had projected. No objection has been filed.

    In light of the foregoing, the Motion to Withdraw the Appeal is hereby GRANTED.
