ORDER GRANTING REQUEST FOR WITHDRAWAL OF REQUEST FOR HEARING

   This matter arises under Section167 of the Workforce Investment Act, ("WIA") 29 U.S.C. §2911, et seq. On July 8, 2003, Complainant filed a request for an administrative hearing, pursuant to 20 C.F.R. § 667.825 and 667.800(a), before the Office of Administrative Law Judges as an appeal to Respondents' denial of its application for designation as a WIA, Section 167 grantee for the Program Year beginning July 1, 2003.

   On August 14, 2003, Complainant filed with this Office a letter requesting to withdraw its request for an administrative hearing because Respondents announced on July 23, 2003, "that they awarded the WIA 167 grant to [Complainant] for the service area of Tennessee for Program Year 2003 and, subject to availability of funding, for Program Year 2004." Accordingly,

   IT IS HEREBY ORDERED that Complainant's request to withdraw is GRANTED. This matter shall be DISMISSED and marked as CLOSED.
