   This proceeding arises under Section 405 of the Surface Transportation Assistance Act of 1982, 49 U.S.C. § 31105. The parties have submitted a signed Settlement Agreement entered into in December 1999.

   I have reviewed the terms of the Settlement Agreement, and I find them fair, adequate, and reasonable. Accordingly,

   IT IS ORDERED that the attached Settlement Agreement is APPROVED.

   IT IS FURTHER ORDERED that Complainant's request to dismiss his claim be, and it is hereby, GRANTED WITH PREJUDICE.
