                 DECISION AND ORDER

     This matter was scheduled for formal hearing in Klamath
Falls, Oregon at 9:00 a.m., January 19, 1995, under the
provisions of the Federal Water Pollution Control Act, 33 U.S.C.
Section 1251 et seq., and the provisions of 29 CFR Part 24
et seq.,

     Pursuant to notice Michael Parker, Complainant, and the City
of Merrill, Respondent, appeared at the indicated time.

     After commencement of the proceedings Complainant, Michael
Parker, stated that he had no defense to the finding that his
claim was not timely filed, and asked that his complaint be
dismissed.  Upon withdrawing his complaint, his motion was
granted and the case was dismissed.

     Accordingly, this matter is dismissed, with prejudice.

     It is so ORDERED.
