ORDER
In a Motion for Partial Summary Judgment filed August 4,
1989, Claimant seeks (1) monetary damages for a breach of
contract by Respondent Tennessee Valley Authority, (2) lost wages
resulting from "blacklisting" by Mississippi Power and Light
Company, (3) legal expenses to date, (4) other damages, and
(5) reimbursement of certain out of pocket expenses. Assuming,
without deciding that this Office would have jurisdiction to
consider and decide these demands, consideration could only be
had after a favorable decision to the Claimant on the merits of
his original claims against Respondents. Those merits not having
been resolved, this Motion is premature and accordingly is
DISMISSED WITHOUT PREJUDICE.
