Summaries of Court Decisions (April 2010)

We have posted our April 2010 monthly summary of significant FOIA court decisions. This summary, as well as previous monthly summaries, can always be found on our Court Decisions page. We also organize court decisions by topic to make it easier for you to find new decisions in specific topical areas. So, for example, if you are interested in looking at the latest cases addressing Exemption 7(D), you can check our Court Decisions by Topic feature and look under the heading “Exemption 7(D)” to get the most up to date list of case summaries on that topic.

Change of Location for Best Practices Working Group

Due to the overwhelming response, OIP has moved the location of the Best Practices Working Group to a larger venue that will accommodate more people. The details are:

Change of Date for Best Practices Working Group

Given the level of interest in the FOIA Best Practices Working Group, OIP is moving up the date for the first meeting of the group. This Working Group will now meet first on June 15th. The details are:

To facilitate the exchange of ideas, space will be limited to approximately forty federal employees. Please register in advance for the Best Practices Working Group (or for the Technology Working Group to be held on June 10) with OIP’s Training Officer, Bertina Adams Cleveland, at (202) 514-1010.

Statutes Found to Qualify under Exemption 3 of the FOIA

On December 9, 2009, the Office of Information Policy posted a chart listing the statutes that courts have found to qualify under Exemption 3 of the FOIA. A description of the material covered by each statute is included in the chart, as well as relevant case citations. The Exemption 3 chart is posted on OIP’s home page and will be updated regularly.

OIP Convening Two FOIA Working Groups

Agency FOIA professionals typically find that working collaboratively and sharing experiences with fellow access professionals can be quite beneficial. To facilitate the exchange of ideas and information between agencies, OIP is convening two FOIA Working Groups. As agencies enter into their second year of work in improving the administration of the FOIA in accordance with the President’s Memorandum on the FOIA and the Attorney General’s FOIA Guidelines, this is an appropriate time for agencies to build on the successes of one another.
