Federal legal requirements apply to specific activities associated with a carbon sequestration project.
A number of federal laws, regulations, and Executive Orders apply to carbon sequestration activities. For the most part, state laws and regulations would not apply to sequestration activities on tribal lands.
The extent to which federal requirements will apply depends upon the nature of the project, its location, and its size. In addition, the requirements applicable to projects conducted under a Tribal Energy Resource Agreement (TERA) may be different from those that apply to projects developed under other existing regulatory programs.
