Legislation establishing national environmental policy and goals for the protection, maintenance, and enhancement of the environment. NEPA (42 USC 4321 et seq.) established the President’s Council on Environmental Quality (CEQ) and required that federal agencies establish procedures for evaluating the impacts of their actions on the natural and human environment. Federal agencies are required to involve stakeholders in the NEPA process. The full suite of NEPA regulations promulgated by the CEQ is located at 40 CFR 1500-1508. NEPA requirements will not apply to tribes undertaking energy development under a Tribal Energy Resource Agreement, although they will be required to conduct an environmental impact analysis that is substantively equivalent to a NEPA analysis. |
