NOTICE OF COMMISSION DETERMINATION NOT TO REVIEW AN INITIAL DETERMINATION EXTENDING THE TARGET DATE FOR COMPLETION OF THE INVESTIGATION

SUMMARY: Notice is hereby given that the U.S. International Trade Commission has determined not to review the presiding administrative law judge's ("ALJ's") initial determination ("ID") extending the target date for completion of the above-captioned investigation by two months, or until September 10, 2002.

SUPPLEMENTARY INFORMATION: The Commission instituted this investigation, which concerns allegations of unfair acts in violation of section 337 of the Tariff Act of 1930 in the importation and sale of certain wireless network interface cards and access points for use in direct sequcne spread spectrum local area networks and products containing same, on April 9, 2001. 66 Fed. Reg. 18507.

The former target date for completion of this investigation, July 9, 2002, was 15 months from the date of institution of the investigation. On August 8, 2001, the ALJ issued an ID extending the target date for completion of the investigation to September 10, 2002, which is 17 months from the date of institution. The ALJ determined that the target date should be extended due to the demands of other investigations on his schedule. None of the parties filed a petition to review the ID.

The authority for the Commission's determination is contained in section 337 of the Tariff Act of 1930, as amended (19 U.S.C. § 1337), and in section 210.42 of the Commission's Rules of Practice and Procedure (19 C.F.R. § 210.42).
