Truck Driver Involved in Fatal Accident Pleads Guilty to Falsifying Log Books

Summary

Damon D. Diffenderfer, a driver for G.W.D. Trucking Company (G.W.D.) of Mays Landing, NJ pled guilty in U.S. District Court in Camden, NJ to one count of making a false statement in connection with daily log books which concealed “hours-of-service” violations. Sentencing is expected in April 2005. In May 2004, a 17-count indictment was issued against Damon Diffenderfer as well as G.W.D. and its owners, Gerald W. and Rose Marie Diffenderfer on related charges of conspiracy and false statements or entries. Diffenderfer is currently serving three years in state prison following his conviction on vehicular homicide charges stemming from a fatal vehicle crash on the NJ Turnpike in April. This investigation was conducted jointly with the NJ State Police and the Middlesex County, NJ Prosecutor’s Office, with assistance from FMCSA.
