Company Fined and VP Gets Jail Time For Hazardous Materials Violations

Summary

Garden State Tobacco Company (GST), of Neptune, NJ, d/b/a H.J. Bailey Co., and Vice President, Allen S. Roth, were sentenced in U.S. District Court, Philadelphia, for criminal violations of the Hazardous Material Transportation Law. In May 2004, GST and Roth each entered guilty pleas stemming from a prior charge that, between January 2000 and August 2003, GST and Roth had transported over 10,000 shipments of flammable butane canisters and gas-charged lighters in unmarked packages via ground services (UPS and FedEx) in violation of DOT regulations. GST was fined $500,000 and sentenced to four years’ probation; Roth was sentenced to one month in jail and fined $10,000. RSPA assisted with this investigation.
