James A. Schlosser, Fletcher, NC, an authorized third-party commercial driver’s license (CDL) tester, pleaded guilty in U.S. District Court in Raleigh, NC, to lying to FMCSA in connection with a scheme to falsify CDL tests. Between March and December 1997, Schlosser falsified CDL tests. Schlosser was the final defendant in a conspiracy involving Lee Roy and Elmer Searcey, who pleaded guilty in May 2000 to fraudulently using Schlosser’s testing certification number to administer CDL exams, which Schlosser then signed as though he had administered them. The criminal investigation resulted in North Carolina suspending 67 CDL licenses and requiring the applicants to take legitimate CDL tests, which many failed. OIG conducted the investigation jointly with the NC Division of Motor Vehicles and the FBI, with assistance from FMCSA.
