Revised Montana Stream Mitigation Procedure - 1/31/2013: The Montana Stream Mitigation Procedure published on January 30, 2013, is a revision to the May 2010 edition of the Montana Stream Mitigation Procedure. The intent of the procedure is to comply with the requirements for mitigation found in 33 CFR parts 320 and 332 and to provide a method for calculating compensatory mitigation debits and credits that will provide predictability and consistency for applicants. Updates include condensing the document and removing any unessential language, reworking the credit and debit worksheets to be more user friendly, and making the document more applicable to the types of stream impacts typical of Montana. No comments are being solicited by this public notice.

NWO-2012-01040-MTB - 1/22/2013: Joint Public Notice for the Lower-Middle Yellowstone Mitigation Banking Umbrella Agreement in Treasure, Rosebud, and Carter Counties, Montana submitted to the US Army Corps of Engineers, in cooperation with the Interagency Review Team. Section 404 of the Clean Water Act establishes a permit requirement, administered by the Corps, for projects that involve discharging dredged or fill material into waters of the United States. The Corps requires compensatory mitigation as a permit condition for stream or wetland losses that are determined to have greater than minimal effects. The goal of mitigation is to replace the physical, chemical, and biological functions of these waters of the US. The mitigation banking concept was established to provide alternatives to applicant-provided mitigation and ease the regulatory burden of mitigating permitted impacts to waters of the US.
