Traveling with Children

I am divorced.  Do I need permission from my former spouse to take my minor children to the United States?

There is no U.S. requirement to have your former spouse’s permission to take your children to the United States.  Airlines and passenger ship companies, however, may have their own rules about transportation of children.  The same is true for countries from which flights and voyages depart for the U.S.

My children are included in my passport. Do they need their own passports to go to the US under the Visa Waiver Program?

Children, even infants, need their own machine-readable passports for travel under the Visa Waiver Program.
