NWO-1982-04701-PIE - 2/14/2013: In accordance with 33 CFR § 323.2, paragraph (h) and 33 CFR § 325.5, paragraph (c) as published November 13, 1986, in the Federal Register, Volume 51, number 219, the Corps of Engineers, Omaha District, proposes to reissue a regional general permit (General Permit 82-07) for the construction of boat ramps and attendant features in South Dakota Waterways under Section 10 of the Rivers and Harbors Act and Section 404 of the Clean Water Act. The District Engineer is authorized to use an alternative procedure for evaluating permit applications for categories of activities that are substantially similar and will cause only minimal individual or cumulative impacts. This alternative procedure avoids unnecessary duplication of regulatory control exercised by other government agencies. The District Engineer, Omaha District, proposes to reissue this regional general permit for a period of five (5) years.

NWO-1991-75996-PIE - 2/7/2013: The Corps of Engineers, Omaha District, proposes to re-issue Regional General Permit 91-04 for the South Dakota Department of Game, Fish and Parks construction of artificial reefs and spawning beds in ponds, lakes and reservoirs within the State of South Dakota. In accordance with 33 CFR § 325.2(e)(2) and 33 CFR § 325.5(c), the District Engineer is authorized to use an alternative procedure for evaluating permit applications for categories of activities that are substantially similar and will cause only minimal individual or cumulative impacts. This alternative procedure avoids unnecessary duplication of regulatory control exercised by other government agencies. The District Engineer, Omaha District, proposes to re-issue this regional general permit for a period of five (5) years. No changes to the existing permit are proposed.

NWO-2007-2601-MTM - 2/6/2013: Northern Express Transportation Facility proposes to relocate a small BNSF rail facility from a residential and commercial area within the City of Shelby, MT to an industrial park southeast of the city. The project would consist of the construction of approximately 10,800 Linear Feet (LF) of new railroad track, construction of a second access road and 13th street (8,800 LF) and road upgrades to SE Front Street (2,200 LF), installation of necessary utilities including water main (14,500 LF), natural gas, power, communication, storm water and sanitary sewer facilities (13,200 LF) to the project site, and construction of a laydown yard (37 acres) to stage oversized equipment. Approximately 1.53 acres of permanent wetland impacts would occur due to the development of the industrial site with approximately 10,464 cubic yards of earthen fill, 1,558 cubic yards of gravel base and 510 cubic yards of ballast would be placed into the wetlands. In addition, 280 linear feet of pipeline and 482 linear feet of new railroad track would be placed into the wetlands.

NWO-1996-21008-PIE - 2/5/2013: General Permit 96-08 will expire on March 31, 2013. The District Commander, Omaha District proposes to re-issue this Regional General Permit for a period of five (5) years. The General Permit will continue to authorize work in waters of the United States (including rivers, lakes, streams and wetland areas) associated with flood protection, reconstruction and repair activities in South Dakota, excluding segments of the Missouri River National Recreation River from river mile 753.60 (Ponca Sate Park, Nebraska) to mile 811.05 (Gavins Point Dam) and from mile 841.00 (near Running Water, South Dakota) to mile 880.00 (Fort Randall Dam). The coverage area of the General Permit has been expanded to include waters in western South Dakota.

Revised Montana Stream Mitigation Procedure - 1/31/2013: The Montana Stream Mitigation Procedure published on January 30, 2013, is a revision to the May 2010 edition of the Montana Stream Mitigation Procedure. The intent of the procedure is to comply with the requirements for mitigation found in 33 CFR parts 320 and 332 and to provide a method for calculating compensatory mitigation debits and credits that will provide predictability and consistency for applicants. Updates include condensing the document and removing any unessential language, reworking the credit and debit worksheets to be more user friendly, and making the document more applicable to the types of stream impacts typical of Montana. No comments are being solicited by this public notice.
