Information on Filing I-130 Petitions in Mongolia

Form I-130, Petition for Alien Relative can be filed in Mongolia and adjudicated when the petitioner and the visa applicant are physically present in the district and the beneficiary is like to be able to remain in the country for the time it normally takes to process the visa.

Who May file in Mongolia  

  1. The petitioner is a resident of the consular district.  The petitioner must have maintained continuous residency in the consular district a minimum of the preceding six months in order to demonstrate residency; or
  2. Acting on the petition is in the national interest; or
  3. An emergent or humanitarian situation exists.

Filing the I-130 Petition

Along with the I-130 petition, you must also submit originals of;

  • your marriage certificate
  • proof of U.S. citizenship/lawful permanent residence card
  • proof of termination of any prior marriage(s)
  • photographs, one for your self and one for your spouse are to be attached along with the Form G-325A (Biographic Information).  Please note that failure to provide complete and accurate information could result in a delay in processing the petition and subsequent immigrant visa.
  • birth certificate of your alien spouse (If your spouse is not a Mongolian citizen, and she is here in Mongolia, you must also provide a copy of her passport.

* If you provide copies of all your documents, the originals will be returned to you.  We are not obligated to make copies for you.

The filing fee $420.00 can be paid by US or Mongolian currency.  No personal checks can be accepted. Additional $404.00 for IV processing and for the visa interview.

I-130 Petitions can be filed from 1-3pm on Fridays with the Embassy. 

On the day you file the petition, your petition will be reviewed for completeness and verification of information provided.

After the petition has been approved, a Beneficiary will be notified and advised to apply for an Immigrant Visa.
