Filing an I-129F Petition (for K visas) with USCIS

Fiancé Visas. (K1)  For men or women traveling to the US to marry an US citizen (Petitions are only accepted in the US)

U.S. Citizens may file an I-129F petition with U.S. Citizenship and Immigration Services (USCIS) for the issuance of a K-1 visa to an alien fiancé who is residing abroad.  To file an I-129F petition, the U.S. Citizen and alien must have met personfally at least once in the two years before the petition was filed.  Unmarried children under 21 of the alien fiancé are eligible for K-2 visas.

The couple must remain unmarried until the alien fiancé arrives in the U.S.  The wedding must take place within three months of the arrival in order for the alien to maintain legal status in the U.S. If your alien fiancé is already in the U.S., contact USCIS.

Legal Permanent Residents may not file petitions for fiancé visas. They must marry abroad and then file an I-130 petition for the immigration of their spouse.
 
If you are filing a petition for your fiancée, you must file an I-129F petition with the USCIS office nearest your place of residence (Only in the US).  Once USCIS approves the petition, they will send the petitioner a notice of approval (Form I-797). USCIS will also forward the approved petition to the National Visa Center which will contact the intending immigrant with further information.

The NVC will assign a case number starting with MNG and they will send it to Immigrant Visa Unit at the US Embassy in Managua.  Once this office has received your K visa case from the National Visa Center, the Immigrant Visa Unit (IV Unit) will send you a packet 4 instruction including a checklist of required documents.  Once you have completed gathering and completing the information and forms required and we have received the corresponding copies from you, the IV Unit will schedule your final visa interview.

The processing time for a fiancé visa is frequently shorter than for an alien spouse.  Fiancé visa processing can take several months from the filing of the petition to the final adjudication of the visa.

The Medical Examination

The Immigration and Nationality Act (INA) requires that all immigrant visa applicants and certain non immigrant visa applicants (including K fiancé visa applicants), regardless of age, undergo a medical examination performed by one of our panel physicians before receiving a visa.  The medical exam is valid for 1 year. We cannot accept medical examination results from other sources. 

The fee for the medical exam, which is paid in dollars, is in addition to fees paid directly to the US government.  For the cost of fees you must contact the panel physicians directly.

Schedule a Visa Interview

Appointments are necessary for immigrant visa interviews. Everyone applying for immigrant visa or K visa must appear in person: the principal applicant and eligible accompanying family members or derivatives.  Petitioners are not required to appear at the time of the visa interview; however, they are welcome to do so if they wish. 
 
Visa interviews are conducted Tuesday to Thursday by appointments only, with the exception of U.S. and Nicaraguan holidays.  We strive to process all applicants promptly and efficiently, but please plan for the process to take 2-3 hours. If all the required documentation is in order and the interviewing officer is satisfied that the beneficiary qualifies for the immigrant visa, the visa will be authorized and you will receive your visa within one week. If not, you will be instructed how to proceed with your case. Please be advised that your case will be delayed further if you are missing documents.

For your convenience you may opt to use a delivery service to receive your passport and visa package.  This is done trough CargoTrans without an additional cost. If your visa application is approved, your passport and visa package will be returned to you by the Cargo Expreso courier service. Your documents will be delivered to the address you provided when you scheduled your interview appointment.

Please do not purchase a plane ticket or make travel arrangements to go to the U.S. until you have the visa in your hands or possession.
