Possible Derivative Claim to U.S. Citizenship

Applicants over the age of 18, born outside the United States to one or both United States citizen parent(s), may have a derivative claim to U.S. citizenship. Applicants under the age of 18 should refer to the Consular Report of Birth Abroad (CRBA) information.

If your parent(s) had previously registered you as a United States citizen after your birth, one of the following documents would have been issued to you, and is evidence of your U.S. Citizenship.

  1. Consular Report of Birth Abroad of a Citizen of the United States of America (Form FS-240);
  2. Certification of Birth Abroad (Form FS-545 or DS-1350);
  3. Certificate of Citizenship;
  4. Your name had been included on your U.S. citizen parent's passport before 1981.

If you believe one of the first three may have been issued to you, but are unable to locate it, you must obtain a certified copy from the Department of State or the U.S. Citizenship and Immigration Service (UCSIS) before you can apply for a U.S. Passport.

Completing the application

Please type or print legibly in black ink. Print out and submit only one-sided pages of the application, and bring all required supporting documents in original format.

To be presented in person at the Consulate:

In order to determine whether or not the U.S. citizen parent(s) is/are able to transmit citizenship, please refer to the transmission requirements. If the transmission requirements have been met, please submit the following in person at the Consulate General serving your area:

  1. Completed (but not signed) passport application (Form DS-11);
  2. Affidavit of Parentage, Physical Presence and Support* (PDF/172KB), completed by the U.S. citizen parent;
  3. Applicant’s Birth Certificate;
  4. U.S. Citizen Parent(s)’ evidence of U.S. Citizenship (U.S. passport or naturalization certificate);
  5. Parents’ registered marriage certificate (if applicable);
  6. Evidence of termination of parents previous marriage(s) (if applicable);
  7. U.S. Citizen Parent’s documentary evidence of physical presence in the United States prior to the child’s birth. Such evidence may include (but is not limited to) academic transcripts, employment records, periods of honorable U.S. military service records, or Wage and tax statements (W-2)’s;
  8. Applicants evidence of identity;
  9. One (1) U.S. sized passport photograph. (Note: these are a different size from Australian sized passport photographs. See our list of known photographers);
  10. Self-addressed Express Post or Express Post Platinum envelope for return of the U.S. passport. Please not that we are unable to accept Registered Post envelopes to return the documents;
  11. If applicable — Original documentation to support name change or change of other descriptive data (certified photocopies are not acceptable);
  12. Applicable Fee. (All fees are subject to change without notice)

Once you have completed all appropriate application forms and gathered all required supporting documentation, make an appointment to lodge the application. Please make sure you print your appointment confirmation to show to the Consulate Security.

Helpful hints for ACS applications

  • Please click here for important information for U.S. citizens who have used (or who are considering to use) Assisted Reproductive Technology (ART) abroad. For citizenship purposes, ART includes in-vitro fertilization, surrogacy arrangements and the use of egg and sperm donors. If ART was used to concieve your child and you are unsure as to how to proceed with an application, please contact the American Citizen Services (ACS) Unit at the U.S. Consulate General serving your state.

  • Please refer to the Department of State's worldwide advice regarding Consular Reports of Birth Abroad.

    Make a copy of all supporting documents (not the application forms) to leave with us. If photocopies are not provided, you will need to pay $1 USD for each photocopy (if you are also applying for a Social Security Number, please make two (2) copies of each supporting document);
