Porting H-1B Status


It is possible to “port” (transfer) H-1B status from one employer to another.  The advantage to this is that you are work-authorized for the new employer as soon as it files the H-1B petition – there is no need to wait for the approval notice to be issued. This interim work authorization extends for as long as the H-1B petition remains pending with the USCIS.  If the H-1B visa stamp is unexpired, you also may travel outside the U.S., even while the “portability” petition is pending, provided you discuss your situation with the Visa Office first.

As with all New Hires, you should receive an Offer of Employment Letter from the Employment Office.  Once you accept the Offer, the Visa Office will contact you.  (It sometimes speeds matters if you cc the Visa Office on your acceptance, to ensure that we are aware of your situation.) 

In addition to the regular documents requested from the Visa Office, it often is extremely helpful to provide a copy of the H-1B petition filed by your current employer.

Is your employment scheduled to start soon, and are you worried about whether there is sufficient time for your visa processing?  If so, please complete our Early Notice Questionnaire.  This will let the Visa Office know about your situation and with whom in Fermilab you have been communicating, so that we can follow up about your paperwork if necessary.
