Delaware Department of Education (DDOE)  

The State of Delaware will ensure that Pencader students complete the school year and that Pencader teachers receive their compensation for their work, under a plan the state presented to the charter school's leadership Thursday.

The state's offer of help comes with several conditions the school must meet to ensure that the school fulfills its academic obligations to its students, the money will only fund outstanding payroll, and student records transfers and other transitional needs are completed when the school closes in June.

"The State chose to work with Pencader's leadership because we both recognize that the educators who could have lost salary that they had earned are innocent parties in this. We want to ensure they receive their proper compensation and that students are able to complete their school year," Department of Education Chief of Staff Mary Kate McLaughlin said.

Earlier this month, Pencader requested $350,000 from the state, saying it needed this amount to complete the school year. The Delaware Department of Education, Division of Accounting, Department of Finance and Office of Management and Budget reviewed the request to evaluate current spending and understand how the school could best allow students to finish out the year. The review of Pencader's finances found a $463,000 shortfall, including $350,000 needed to cover final paychecks for staff.

If the school accepts the State's offer of help, the State money would go toward that payroll. The State expects the school to negotiate its outstanding $113,000 expenses with its creditors.

"Make no mistake, this is a burden to the State," McLaughlin said. "But at the end of the day, these are teachers who have earned salaries by educating hundreds of Delaware's students. While we may not have a legal obligation to cover their salaries for Pencader, we value their work and want to ensure these educators are not the ones hurt by the school's financial mistakes."
