Checklist E-2 Treaty Investor Visa Application Procedures For A First-Time Registration In Oslo

Tab 1 a

  • A current photograph complying with U.S. visa photo requirements;
  • Non-immigrant Visa Application Form DS-160;
  • MRV application fee in bank remisse or US postal money order.
  • A photocopy of the principal applicant’s passport

A completed Form DS-156E. Contact information must include an e-mail address and all questions must be answered fully.

Tab 1 c
A cover letter describing the enterprise and the beneficiary. The letter must address how the enterprise and employee meet the E-2 visa requirements.

Tab 2 a
A business plan for the next five years, and if an existing enterprise, also include tax returns for the past three years.

Tab 2 b
Evidence of company ownership and its articles of incorporation.

Tab 2 c
Evidence that the applicant has invested or is in the process of investing:  contracts, promissory notes, leases, purchase contracts, or bank statements.

Tab 3 a
Evidence that the enterprise is a real and operating commercial enterprise:   annual income statements, catalogs, business invoices and corresponding bank, receipts, purchases, or employee payment records.

Tab 3 b
Evidence that the applicant’s investment is substantial and proportionate to the value of the enterprise. Start-up costs must be identified, and documentation must demonstrate that the investment is more than a marginal one solely for earning a living.

Tab 4
Evidence that the applicant, if an employee, is destined to an executive or supervisory position:  copies of the applicant’s curriculum vitae or resume;  a detailed job description; an organization chart of U.S. operations to indicate whom the employees supervises and to whom s/he reports.  Evidence that the applicant possesses skills essential to the firm’s operations in the United States.
