Fiancé(e) Visas

General Information

  • K-1 visas are for fiancé(e)s of U.S. citizens who plan to marry in the U.S. and then reside in the U.S.  The K-1 visa permits the foreign-citizen fiancé(e) to travel to the United States and marry his or her U.S. citizen sponsor within 90 days of arrival.  The foreign-citizen will then apply for adjustment of status to a legal permanent resident (LPR) with the Department of Homeland Security’s (DHS) U.S. Citizenship and Immigration Service (USCIS).  Both the U.S. citizen and the K-1 visa applicant must have been legally free to marry at the time the petition was filed and must have remained so thereafter. The marriage must be legally possible according to the laws of the U.S. state in which the marriage will take place.  K-2 visas are for the eligible minor children (under 21 years of age) of K-1 applicants who plan to live in the U.S. with their K-1 parent.
  • K-3 visas are for spouses of U.S. citizens who wish to come to the United States and wait there while they complete their immigration process. K-4 visas are for the minor children (under 21 years of age) of K-3 applicants who plan to live in the U.S. with their K-3 parent.
  • The advantage of K visas is that they allow the engaged couple or the husband and wife (and their minor children) to be together in the United States while completing the immigrant visa process.
  • A K visa is not a substitute for a regular immigrant visa. The applicant(s) will still have to meet all the requirements for a regular immigrant visa when they apply with USCIS to adjust status in the U.S.  
  • K-2 and K-4 visas cannot be issued to children until the primary applicant parent has been issued a K-1 or K-3 visa.
