COMMISSION MEETINGS AND HEARINGS

On June 27, the Commission held an open audit hearing on the Washington State Republican Party.

No Commission Executive Sessions or Open Meetings were scheduled this week.

ADVISORY OPINIONS

Requests Received

AOR 2012-22 (skimmerhat). On June 26, the Commission made public Advisory Opinion Request 2012-22 (skimmerhat).  The requestor asks whether its planned web-based contribution platform is permissible under the Federal Election Campaign Act of 1971, as amended, or Commission regulations. The Commission will accept written comments on the request during the 10-day period following the request being made public, specifically no later than July 6, 2012, and must issue a response no later than 60 days after receipt of the complete request, specifically by August 20, 2012.

Commissioners’ Statements Issued

AO 2012-19 (American Future Fund). On June 29, Commissioner Donald F. McGahn issued a Statement.

ADMINISTRATIVE FINES

The Commission made public eight campaign finance enforcement matters that were resolved through its Administrative Fines (AF) program.

AF 2263 – Wyden for Senate and Louis Savage, in his official capacity as treasurer. The Commission made a final determination and assessed a civil penalty of $7,340.

AF 2295 – Mike Thurmond for US Senate 2010 and Matthew Ware, in his official capacity as treasurer. The Commission made a final determination and assessed a civil penalty of $3,580.

AF 2499 – General Atomics Political Action Committee and Karen A. Baldwin, in her official capacity as treasurer. The Commission made a final determination and assessed a civil penalty of $825.

AF 2500 – Dallas County Republican Party - Primary and Hon. Wade Emmert, in his official capacity as treasurer. The Commission made a final determination and assessed a civil penalty of $105.

AF 2501 – Women’s Campaign Forum and Siobhan Bennett, in her official capacity as treasurer. The Commission made a final determination and assessed a civil penalty of $262.

AF 2503 – Buck McKeon for Congress and Patricia McKeon, in her official capacity as treasurer. The Commission made a final determination and assessed a civil penalty of $4,600.

AF 2504 – Friends of Tim Burns and George K. McLaughlin, in his official capacity as treasurer. The Commission made a final determination and assessed a civil penalty of $4,500.

AF 2505 – Jackson for Virginia and Theodora J. Jackson, in her official capacity as treasurer. The Commission made a final determination and assessed a civil penalty of $360.

LITIGATION

FEC v. Citizens Club for Growth, Inc. (No. 05-cv-01851 (RLW)). On June 25, the United States District Court for the District of Columbia issued an order regarding defendant's motion to enforce protective order.

Herron for Congress v. FEC (No. 11-cv-01466 (EGS)). On June 25, the Commission filed a Reply in Support of its Motion for Summary Judgment in the United States District Court for the District of Columbia.

Shaun McCutcheon, et al. v. FEC (No. 12-cv-01034 (JEB)). On June 22, plaintiffs filed a Complaint and a Motion for Preliminary Injunction in the United States District Court for the District of Columbia.

Van Hollen v. FEC (No. 12-5117). On June 27, Free Speech Coalition, et al. filed a Corrected Brief Amicus Curiae in Support of Appellants and Reversal in the United States Court of Appeals for the District of Columbia Circuit.
