COMMISSION MEETINGS

ADVISORY OPINIONS

Request Received

AOR 2010-06 (Famos LLC). On April 6, the Commission made public Advisory Opinion Request 2010-06. Famos seeks to operate an affinity-type account program and market its web-based technology platform to political committees, including authorized committees, nonconnected committees, and party committees. The Commission must issue a response no later than 60 days after receipt of the complete request, that is, by June 1, 2010.

Supplement Received

AOR 2010-04 (Wawa, Inc.). On April 6, the Commission made public a Supplement to Advisory Opinion Request 2010-04. The requester asks for clarification of which persons fall within the restricted class that may be solicited at any time by Wawa, Inc.’s Separate Segregated Fund. The Commission must issue a response no later than 60 days after receipt of the complete request, that is, by May 9, 2010.

AUDIT REPORTS

The Commission approved and made public an Audit Report. A summary of the findings is below. Final Audit Reports are available here.

Committee to Elect Alan Grayson. The audit found a material misstatement of financial activity in 2007 and 2008. The committee filed amended reports to correct the issues raised in the audit process.

LITIGATION

The Real Truth About Obama, Inc. v. Federal Election Commission. On April 6, the petitioner filed with the United States Supreme Court a reply to the brief previously filed by United States Solicitor General Elena Kagan.

RULEMAKING AND AGENCY PROCEDURES

The Federal Election Commission seeks public comment on four alternative drafts of a Volunteer Materials Exemption Policy, which are accessible on the Commission's website at http://www.fec.gov/law/policy.shtml#volunteer.  Commenters are encouraged to review the drafts and submit comments, which are due by 5:00 pm on April 13, 2010, to VMEpolicy@fec.gov.

On April 9, the Commission adopted the Final Rules and Explanation and Justification on Collection of Administrative Debts and Collection of Debts Arising from Enforcement and Administration of Campaign Finance Laws.

On April 8, the Commission posted the transcripts of the public hearing on the Notice of Proposed Rulemaking on Coordinated Communications (“NPRM”) and Supplemental Notice of Proposed Rulemaking on Coordinated Communications. The NPRM presents possible alternatives to the regulations that govern communications made in coordination with federal candidates, their authorized committees or political parties but paid for by other persons. The NPRM also proposes to define “promote, support, attack, or oppose.”
