The Health Care Quality Improvement Act of 1986 called for the creation of a national system to track practitioners on whose behalf a malpractice (tort) claim had been paid. This act authorized the creation of the National Practitioner Data Bank (NPDB), which is administered by the Department of Health and Human Services (HHS). Per a Memorandum of Understanding with HHS, VHA participates in this process.

The Office of Medical-Legal Affairs is charged with coordinating and convening panels to review all paid VHA tort claims for the determination if the standard of care was rendered and the identification of licensed practitioners for reporting to the NPDB.
