An Illinois police chief has banned his officers from a Belleville Denny’s Restaurant after a manager told five on-duty detectives they had to leave because one of them had a firearm.


“The Belleville Police Department is very disheartened by the lack of respect shown to on-duty sworn police officers, Capt. Don Sax said in a statement to Fox News. “Until further notice all on duty Belleville Police officers are banned from Denny’s Restaurant unless responding to an official call for service.”

The incident occurred on New Year’s Day when five detectives were eating at the restaurant. A manager approached their table and told one of the detectives that she had to take her weapon out to her car or leave the restaurant.

The detectives initially thought it was a joke, Sax said, noting that all of the officers had displayed their badges and several police radios were on the table.

“(The manager) stated that he had a complaint from another customer about the weapon and she had to take the weapon outside or leave,” he said.

The manager told the detectives that Denny’s only allows officers in uniform to carry weapons. The detectives said that wasn’t going to happen so they got up to leave.

Sax said the restaurant’s general manager eventually came over and said it was fine for the detectives to be in the restaurant.

“At this point the detectives were very embarrassed and felt the situation was entirely too awkward for them to remain and all left the restaurant,” Sax said.

A spokesperson for Denny’s told Fox News told Fox News the restaurant manager made a mistake. They do allow both uniformed and non-uniformed officers to carry weapons in the restaurant.

The spokesman said it was a case of miscommunication. They said the manager was trying to do the right thing after a diner had complained.

Denny’s said they regret any misunderstanding.

Looking back over the last four years, it is now obvious that the greatest symbolic moment of President Barack Obama's first term was the very first moment.

That is when Obama placed his left hand on Abraham Lincoln's Bible, raised his right hand, and followed the lead of Chief Justice John Roberts in attempting to recite the oath that all American presidents must take, swearing to preserve, protect and defend the Constitution of the United States.

Obama and Roberts mangled the oath, a poignant precursor of their subsequent exertions to mangle the Constitution itself.

The Constitution says: "Before he enter on the Execution of his Office, he shall take the following Oath or Affirmation: -- 'I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States.'"

After Roberts and Obama failed to recite these words correctly -- as more than a million watched from the National Mall -- Obama decided to take the oath a second time, on Jan. 21, 2009, in front of a few reporters in the White House Map Room.

"We believe that the oath of office was administered effectively and that the president was sworn in appropriately yesterday," White House Counsel Greg Craig said in an explanatory statement. "But the oath appears in the Constitution itself. And out of an abundance of caution, because there was one word out of sequence, Chief Justice Roberts administered the oath a second time."

But if Obama's second oath-taking was essentially a symbolic gesture, it lacked the most powerful element of his first oath-taking: This time he did not use a Bible.

Charles Krauthammer, responded to Bill O’Reilly’s Talking Points Memo. O’Reilly believes that in light of the fiscal cliff fallout, it is clear that President Obama doesn’t care about federal spending.

Krauthammer agreed, adding that there’s “not a shred of evidence President Obama has any interest in cutting spending.”

O’Reilly asked Krauthammer if he thinks President Obama is simply ignorant of macroeconomics. Krauthammer assessed, “No, I think he’s not ignorant but I think he has … this is a man who is so ideological, he is so committed since the days as a community organizer to undoing the injustices he sees in the country.”

“We have the empirical evidence, it’s in from Europe. This can’t go on, this will wreck the country,” Krauthammer warned. “Maybe [President Obama] thinks our economy is so strong. And right now interest rates are essentially zero, so he can spend his second term piling up the debt and deficit […] He doesn’t want to leave a legacy of a man who balanced the budget, he doesn’t care about that.”

Speaker Boehner Promises to Pass Sandy Bill Without Senate Pork So Chill Out Chris Christie!


Speaker Boehner promised Wednesday to pass emergency spending bill to help pay for damage caused by Hurricane Sandy. The House bill will not include the millions of dollars in pork that were included in the Senate bill.

Earlier in the day Governor Chris Christie lashed out at Boehner for not holding a vote on the pork-laden senate bill.

During the 2008 campaign Barack Obama promised not to raise taxes on anyone making less than $250,000 a year.
He lied. Obamacare created seven new taxes on those making less than $250,000 a year.

And, then there’s this.The fiscal cliff bill that passed the US Senate and is likely to pass the US House will raise taxes on those making $100,000 a year by $2,000.

In a complete victory for President Obama, the House of Representatives tonight passed the “Fiscal Cliff” Deal, that raises taxes but does not cut spending, by an overwhelming vote of 257-167. The majority of Republicans voted against the deal, but enough crossed the aisle to vote with Democrats to put it over the top by a large margin. House Speaker John Boehner voted for the deal, along with GOP Rep. Paul Ryan. House Majority Leader Eric Cantor voted against it. It now moves to President Obama’s desk to be signed into law. The Congressional Budget Office estimates this deal will add another $4 Trillion to the National Debt over the next 10 years.

Senator Dianne Feinstein,

I will not register my weapons should this bill be passed, as I do not believe it is the government's right to know what I own. Nor do I think it prudent to tell you what I own so that it may be taken from me by a group of people who enjoy armed protection yet decry me having the same a crime. You ma'am have overstepped a line that is not your domain. I am a Marine Corps Veteran of 8 years, and I will not have some woman who proclaims the evil of an inanimate object, yet carries one, tell me I may not have one.

They hate guns in the hands of those who think for themselves and do not obey without question. They hate guns in those whom they have slated for a barrel to the back of the ear.

In the course of a follow-up exam today, Secretary Clinton's doctors discovered a blood clot had formed, stemming from the concussion she sustained several weeks ago. She is being treated with anti-coagulants and is at NewYork-Presbyterian Hospital so that they can monitor the medication over the next 48 hours.

Her doctors will continue to assess her condition, including other issues associated with her concussion. They will determine if any further action is required.

Barack Obama appeared on NBC’s “Meet The Press” on Sunday, talking about the “fiscal cliff” negotiations and priorities for his administration in his second term.

“Something fundamental in America has to change,” said Obama, who visited on December 16 with families of victims of the Newtown, Connecticut, school shootings.

The president said Sunday he will put forth a proposal next year to change firearm laws. Among the things the legislation will address are assault-style rifles, high-capacity ammunition magazines and background checks on all firearm sales.

An apple a day may actually keep the doctor away – or even better, keep you from getting a life-threatening blood clot. So might an orange or onion, it turns out. All of these fruits and veggies are high in a flavanoid known as rutin, a natural anti-clotting agent, according to a study published Tuesday.


Each year, approximately one third of all deaths in the United States are caused by a heart attack or stroke.

“It’s not always fully appreciated that the majority of Americans will die as the result of a blood clot in either their heart or their brain,” said the study’s senior author Dr. Robert Flaumenhaft, associate professor at Harvard Medical School and a researcher at Beth Israel Deaconess Medical Center in Boston.

Even with the use of existing anti-clotting therapies, such as aspirin, Plavix and warfarin (Coumadin), an estimated 1,255,000 heart attacks and 795,000 strokes occur each year.

Flaumenhaft and his research team at Beth Israel were looking for a compound that could block the action of a clotting agent, a protein called disulfide isomerase (PDI), which they found is rapidly secreted during thrombosis—when a clot forms in a blood vessel.

But because PDI is necessary for the production of certain proteins, they had to hunt for a compound that could block only certain PDI proteins. When the researchers tested more than 5,000 compounds, rutin emerged as the most potent.

Rutin is found in many fruits and vegetables, including apples (especially the peels), berries, citrus fruits and onions, as well as teas and buckwheat. It is also sold as an herbal supplement. Fortunately, studies have shown that flavanoids are well tolerated and safe.

The researchers then tested rutin to see if it would prevent blood clots in a mouse model.

“Rutin proved to be the most potently anti-thrombotic compound that we ever tested in this model,” said Flaumenhaft. In addition, epidemiologic studies have found that a diet high in flavonoids is associated with a lower risk of heart attack and stroke.

Though clinical trials in people still need to be done, the research is promising and clearly demonstrated that targeting PDI is an effective anti-clotting therapy. Because the Food and Drug Administration has already established that rutin is safe, the flavanoid can be tested in a clinical trial relatively quickly.

Reid said he was gratified Republicans have taken their demand for Social Security cuts off the table, but added that they should’ve never been on the table to begin with.

He said, “There’s still significant distance between the two sides, but negotiations continue. There’s still time left to reach an agreement and we intend to continue negotiations.”

Michelle Obama stutters. She does not have a stutter. She stutters on purpose. “I-I-I, I’ve seen it in our men and women in uniform.” “Fr-from the young person with so much promise.” “And-and, even as a kid…”

It is a studied stutter, deployed in order to build sincerity. It is not so much a rhetorical device as an acting device. The same could be said for the presentation of almost all political convention speeches. And it is, at its core, sad.

And if you’ve listened to Barack at all over the years, you’d know he has the same thing. Don’t believe us? Here is a side-by-side example:

But the similarities don’t end there. Viewers also may have noticed that Michelle uses very familiar hand gestures to Barack:




And in what was perhaps the strongest resemblance, that Michelle Obama used the words “I” and “me” a staggering number of times. She used the two words 83 times in her 25-minute speech, or roughly 3 times a minute.

Her husband is famous for a similarly self-centered rhetorical style. In a 25-minute speech in July, for instance, Obama referred to himself 117 times, according to CNS News. Mathematically, this means the president used the words “I” or “me” roughly 13.09 seconds.

More than 450 teachers and other school employees from around Ohio have applied for 24 spots in a free firearms-training program being offered by the Buckeye Firearms Association.

“We’re pleasantly surprised, but it’s not shocking,” Ken Hanson, legal chairman for the association, said today of the response since the group began taking applications on its website 10 days ago. “The demand has been there for quite some time.”

The issue of arming school employees to protect students has been “on the radar” of school boards in Ohio for several years, he said, but the organization decided to launch its training program after the Dec. 14 shootings at Sandy Hook Elementary School in Newtown, Conn., where a gunman killed 20 children and six adults.

“That was the breaking point,” he said. “We decided it’s time to quit talking about it and move forward.”


The first firearms class, a three-day program at the Tactical Defense Institute in West Union in Adams County, hasn’t been scheduled nor have the participants been chosen. Applications are being accepted at buckeyefirearms.org, the website of the group, which lobbies for the rights of gun owners.

The same week that the Buckeye Firearms Association announced its offer, Ohio Attorney General Mike DeWine said schools should consider arming “someone” in their buildings as the first line of defense against a gunman. Beginning Jan. 14, his office will work with law enforcement and educators to train teachers and administrators to deal with “active shooters.”

The local police union expressed concerns this week about arming teachers or others who work in schools.

“It’s our position that there should be law-enforcement officers in schools,” said Jason Pappas, president of the Fraternal Order of Police Capital City Lodge No. 9. “To have civilians with guns in schools who could be mistaken for an active shooter only causes confusion for law enforcement.”

Columbus school-board member Mike Wiles also prefers trained police officers in schools. He’s willing to listen to all options for keeping students safe, but he said the notion of arming staff members would require support from “the board, the community, the staff, the parents, everybody.”

Hanson said his group likes the idea of police officers in schools but worries that those school officers are among the first lost to budget cuts when school districts encounter financial problems.

Arming teachers and other school employees is “budget neutral,” he said.

Although the Buckeye Firearms Association will fund the first class in its Armed Teacher Training Program, Hanson estimated the cost for tuition, ammunition and lodging for each participant at $1,000.

More than 70 percent of the school employees who have applied are teachers, about half of whom work in elementary schools, he said. Others are administrators and even custodians and food-service workers.

Beginners won’t be accepted. The program is looking for applicants with “significant prior firearms experience,” Hanson said.

John Benner, a former member of the Hamilton County regional SWAT team who owns the Tactical Defense Institute, said the class will be an intensive three-day program in dealing with active shooters.

By the end of the course, only participants who can pass the same firearms tests administered to law-enforcement officers should be armed in a school, Benner said.

“If they can’t qualify, they shouldn’t be carrying a gun,” he said. “There has to be some standard.”

Whether any of those who complete the course can carry guns in schools will be up to individual school boards and perhaps the state legislature.

The Ohio Revised Code allows school boards to give individuals written authorization to carry a gun on school grounds, Hanson said. The law, an exception to the ban on guns in schools, is found in ORC 2923.122.

But the legal counsel for the Ohio School Boards Association sees another legal hurdle to arming teachers or other school employees.

Hollie Reedy referred to ORC 109.78, which says that no public or private educational institution is permitted to employ a person “who goes armed while on duty” unless the person has completed a basic peace-officer training program or has

20 years of active duty as a peace officer.

“(Section) 2923.122 is not the end of the story,” Reedy said. “We have to look at other parts of the code.”

Jonathan Fulkerson, deputy chief counsel for the state attorney general, disagreed with her interpretation of ORC 109.78, which he said addresses the hiring of special police officers or security guards.

“I don’t see how 109.78 would apply to a teacher,” he said. “It covers a whole other area.”

Taxpayers To Start Feeling ObamaCare’s Effects

The re-election of President Obama means Uncle Sam is only going to grow larger. As the new year arrives, Americans are likely to see with their own eyes the consequence of their choice of chief executive as health care costs escalate thanks to Obamacare.

Provisions of the law that take effect in the new year will reveal the true price tag of the president’s signature health care system in the form of five new taxes.

Starting Jan. 1, a 2.3 percent medical device tax will be imposed on the miracles of modern medicine such as heart pacemakers, stents, prosthetic joints and diagnostic scanners. The levy will apply to sales, not profits, so startup firms that might be just breaking even could be pushed into the red by Obamacare. With 80 percent of medical device companies employing fewer than 50 people, the tax is a disincentive for small firms to stay in business — exactly the opposite of the effect needed to jump-start the nation’s flagging economy.


Obamacare will raise the threshold for the tax deductibility of medical bills from 7.5 percent of adjusted gross income to 10 percent, making it harder to write off the cost of health care. Pre-tax flexible spending accounts, which 24 million consumers rely on to pay for medical bills and currently have no federally imposed limit, will be capped at $2,500. These two provisions mean a greater share of families’ income must be devoted to health care, contrary to the promises Democrats made when selling the plan to the public in 2010.

Several other scheduled tax increases are contingent upon negotiations between the president and Congress over the looming “fiscal cliff.” Obamacare is set to raise the capital gains tax rate from 15 percent to 20 percent and dividend rate from 15 percent to 39.6 percent. Families and small-business owners earning more than $250,000 will pay an additional 0.9 percent Medicare payroll tax.

The health care overhaul calls for a $63 per person fee to cover the cost of coverage for individuals with pre-existing medical conditions. Insurance companies forced to foot the bill are expected to pass the cost along to an estimated 190 million Americans in the form of higher insurance premiums. Obamacare even exacts a price on freedom of religion. Supreme Court Justice Sonia Sotomayor on Wednesday turned down craft retailer Hobby Lobby’s request for a stay on the health care law’s requirement that companies pay for abortion pills, regardless of whether that violates the owner’s moral code.

As much as Mr. Obama wishes to prove the liberal proposition that big government knows best, the coming tax increases are likely once again to prove otherwise. Obamacare will extract tax dollars from taxpayers nationwide and funnel them into federal coffers in Washington. From there, legions of faceless bureaucrats in cushy offices will decide who gets health care and how much. The new year will bring Americans a very clear lesson in the shortcomings of a big-government program they opted for with the re-election of Mr. Obama. As their wallets get lighter, it’s a lesson they likely will regret.

Truth is, retired Gen. H. Norman Schwarzkopf didn't care much for his popular "Stormin' Norman" nickname.

The seemingly no-nonsense Desert Storm commander's reputed temper with aides and subordinates supposedly earned him that rough-and-ready moniker. But others around the general, who died Thursday in Tampa, Fla., at age 78 from complications from pneumonia, knew him as a friendly, talkative and even jovial figure who preferred the somewhat milder sobriquet given by his troops: "The Bear."

That one perhaps suited him better later in his life, when he supported various national causes and children's charities while eschewing the spotlight and resisting efforts to draft him to run for political office.

He lived out a quiet retirement in Tampa, where he'd served his last military assignment and where an elementary school bearing his name is testament to his standing in the community.

Schwarzkopf capped an illustrious military career by commanding the U.S.-led international coalition that drove Saddam Hussein's forces out of Kuwait in 1991 — but he'd managed to keep a low profile in the public debate over the second Gulf War against Iraq, saying at one point that he doubted victory would be as easy as the White House and the Pentagon predicted.

Schwarzkopf was named commander in chief of U.S. Central Command at Tampa's MacDill Air Force Base in 1988, overseeing the headquarters for U.S. military and security concerns in nearly two dozen countries stretching across the Middle East to Afghanistan and the rest of central Asia, plus Pakistan.

When Saddam invaded Kuwait two years later to punish it for allegedly stealing Iraqi oil reserves, Schwarzkopf commanded Operation Desert Storm, the coalition of some 30 countries organized by President George H.W. Bush that succeeded in driving the Iraqis out.

At the peak of his postwar national celebrity, Schwarzkopf — a self-proclaimed political independent — rejected suggestions that he run for office, and remained far more private than other generals, although he did serve briefly as a military commentator for NBC.

While focused primarily on charitable enterprises in his later years, he campaigned for President George W. Bush in 2000, but was ambivalent about the 2003 invasion of Iraq. In early 2003 he told The Washington Post that the outcome was an unknown: "What is postwar Iraq going to look like, with the Kurds and the Sunnis and the Shiites? That's a huge question, to my mind. It really should be part of the overall campaign plan."

Initially Schwarzkopf had endorsed the invasion, saying he was convinced that Secretary of State Colin Powell had given the United Nations powerful evidence of Iraqi weapons of mass destruction. After that proved false, he said decisions to go to war should depend on what U.N. weapons inspectors found.

He seldom spoke up during the conflict, but in late 2004 he sharply criticized Defense Secretary Donald H. Rumsfeld and the Pentagon for mistakes that included erroneous judgments about Iraq and inadequate training for Army reservists sent there.

"In the final analysis I think we are behind schedule. ... I don't think we counted on it turning into jihad (holy war)," he said in an NBC interview.

Schwarzkopf was born Aug. 24, 1934, in Trenton, N.J., where his father, Col. H. Norman Schwarzkopf Jr., founder and commander of the New Jersey State Police, was then leading the investigation of the Lindbergh kidnap case. That investigation ended with the arrest and 1936 execution of German-born carpenter Richard Hauptmann for murdering famed aviator Charles Lindbergh's infant son.

The elder Schwarzkopf was named Herbert, but when the son was asked what his "H" stood for, he would reply, "H."

As a teenager Norman accompanied his father to Iran, where the elder Schwarzkopf trained the Iran's national police force and was an adviser to Reza Pahlavi, the young Shah of Iran.

Young Norman studied there and in Switzerland, Germany and Italy, then followed in his father's footsteps to West Point, graduating in 1956 with an engineering degree. After stints in the U.S. and abroad, he earned a master's degree in engineering at the University of Southern California and later taught missile engineering at West Point.

In 1966 he volunteered for Vietnam and served two tours, first as a U.S. adviser to South Vietnamese paratroops and later as a battalion commander in the U.S. Army's Americal Division. He earned three Silver Stars for valor — including one for saving troops from a minefield — plus a Bronze Star, a Purple Heart and three Distinguished Service Medals.

While many career officers left military service embittered by Vietnam, Schwarzkopf was among those who opted to stay and help rebuild the tattered Army into a potent, modernized all-volunteer force.

After Saddam invaded Kuwait in August 1990, Schwarzkopf played a key diplomatic role by helping persuade Saudi Arabia's King Fahd to allow U.S. and other foreign troops to deploy on Saudi territory as a staging area for the war to come.

On Jan. 17, 1991, a five-month buildup called Desert Shield became Operation Desert Storm as allied aircraft attacked Iraqi bases and Baghdad government facilities. The six-week aerial campaign climaxed with a massive ground offensive on Feb. 24-28, routing the Iraqis from Kuwait in 100 hours before U.S. officials called a halt.

Schwarzkopf said afterward he agreed with Bush's decision to stop the war rather than drive to Baghdad to capture Saddam, as his mission had been only to oust the Iraqis from Kuwait.

But in a desert tent meeting with vanquished Iraqi generals, he allowed a key concession on Iraq's use of helicopters, which later backfired by enabling Saddam to crack down more easily on rebellious Shiites and Kurds.

While he later avoided the public second-guessing by academics and think tank experts over the ambiguous outcome of the first Gulf War and its impact on the second Gulf War, he told The Washington Post in 2003, "You can't help but ... with 20/20 hindsight, go back and say, `Look, had we done something different, we probably wouldn't be facing what we are facing today.'"

After retiring from the Army in 1992, Schwarzkopf wrote a best-selling autobiography, "It Doesn't Take A Hero." Of his Gulf War role, he said: "I like to say I'm not a hero. I was lucky enough to lead a very successful war." He was knighted by Queen Elizabeth II and honored with decorations from France, Britain, Belgium, Kuwait, Saudi Arabia, the United Arab Emirates, Qatar and Bahrain.

Schwarzkopf was a national spokesman for prostate cancer awareness and for Recovery of the Grizzly Bear, served on the Nature Conservancy board of governors and was active in various charities for chronically ill children.

"I may have made my reputation as a general in the Army and I'm very proud of that," he once told The Associated Press. "But I've always felt that I was more than one-dimensional. I'd like to think I'm a caring human being. ... It's nice to feel that you have a purpose."

Schwarzkopf and his wife, Brenda, had three children: Cynthia, Jessica and Christian.

In Vietnam in March 1970, Schwarzkopf was involved in rescuing men of his battalion from a minefield. He had received word that men under his command had encountered a minefield on the notorious Batangan Peninsula, he rushed to the scene in his helicopter, as was his custom while a battalion commander, in order to make his helicopter available. He found several soldiers still trapped in the minefield. Schwarzkopf urged them to retrace their steps slowly. Still, one man tripped a mine and was severely wounded but remained conscious. As the wounded man flailed in agony, the soldiers around him feared that he would set off another mine. Schwarzkopf, also wounded by the explosion, crawled across the minefield to the wounded man and held him down (using a “pinning” technique from his wrestling days at West Point) so another could splint his shattered leg. One soldier stepped away to break a branch from a nearby tree to make the splint. In doing so, he too hit a mine, which killed him and the two men closest to him, and blew an arm and a leg off Schwarzkopf’s artillery liaison officer. Eventually, Schwarzkopf led his surviving men to safety, by ordering the division engineers to mark the locations of the mines with shaving cream. (Some of the mines were of French manufacture and dated back to the Indochina conflict of the 1950s; others were brought by Japanese forces in World War II). Schwarzkopf says in his autobiograpy It Doesn’t Take a Hero that this incident firmly cemented his reputation as an officer who would risk his life for the soldiers under his command.

Schwarzkopf told his men that they might not like some of his strict rules, but it was for their own good. He told them “When you get on that plane to go home, if the last thing you think about me is ‘I hate that son of a bitch’, then that is fine because you’re going home alive.” Lt. General Hal Moore later wrote that it was during his time in Vietnam that Schwarzkopf acquired what later became his infamous temper, while arguing via radio for passing American Hueys to land and pick up his wounded men.

To provide all Americans with health insurance, premiums will have to rise to pay for it, Aetna CEO Mark Bertolini told CNBC’s ”Closing Bell” on Wednesday.

“If we’re going to insure all Americans, which is a worthy and appropriate cause, then somebody has to pay for it,” Bertolini said of the expected premium increases under Obamacare.

Bertolini said that insurance premiums could double in some places just on the basis of what types of policies people buy today.

He also said that when Obamacare is fully implemented, it won’t start the way people had hoped and it won’t be cheaper.

Over the longer run, the key to bringing down premiums will be controlling health care costs, he added. “It’ll be fits and starts, but we’ll get there,” Bertolini said.

Higher premiums also will not necessarily mean higher margins for Aetna. “The people coming into the system will be sicker because they have not used services,” Bertolini said. “So in the initial part of this program it will cost more to take care of people because they have been going without health care for so long.”

The Aetna executive also weighed in on the debate over the country’s fiscal situation.

During a discussion on the so-called fiscal cliff on Thursday, Santelli grew louder, eventually shouting into the camera and overpowering CNBC contributor and trader Jim Iuorio, who was attempting to hold back laughter.

“The Fed doesn’t have a clue, neither does the president, neither does Congress … Neither does Tim Geithner, who gives a speech about the debt ceiling. I’d like to see if he could count to a million, much less 16.4 trillion!” Santelli shouted.

Justice Sotomayer ruled in favor of Muslim inmates but ruled against Christian business owners.

The Supreme Court denied a request by Hobby Lobby, a Christian-owned company, to shield the company from the controversial contraceptive mandate. Justice Sonia Sotomayor rejected a request for an emergency injunction that would have shielded employers from the mandate. Hobby Lobby could face fines of up to $1.3 million a day if they do not comply to the Obama mandate.

Yet, as Laura Ingraham pointed out, in a previous case Sotomayor ruled for a Muslim inmate who was denied Ramadan meals. In Ford v. McGinnis, 352 F.3d 582 (2d Cir. 2003), Sotomayor wrote an opinion that reversed a district court decision holding that a Muslim inmate’s First Amendment rights had not been violated because the holiday feast that he was denied was not a mandatory one in Islam. Sotomayor held that the inmate’s First Amendment’s rights were violated because the feast was subjectively important to the inmate’s practice of Islam.
