Announcing the Inaugural Bleacher Report College T-Shirt Contest!

THE BLEACHER REPORT COLLEGE T-SHIRT DESIGN CONTEST OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER. MAKING A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINING A PRIZE. Internet access is required to participate.

This Contest is in no way sponsored, endorsed or administered by, or associated with Facebook.  Facebook is not affiliated with the Sponsor in any way.

1. Contest Overview: The Bleacher Report College T-Shirt Design Contest  (“Contest”) sponsored by Bleacher Report (“Sponsor”) invites eligible individuals (see full eligibility requirements in Rule 3, below) to create and submit an original design for a college-themed t-shirt that demonstrates your school spirit (referred to herein as your “Design” or “entry”). One (1) Grand Prize winner and three (3) Runners-Up will be chosen to receive the prizes described in Rule 10, below, based on the two-part selection process described in Rule 9, below. All decisions of the Sponsor in connection with the Contest will be final and binding.

2. Contest Period: Entry into the Contest begins on August 29 at 12:00:01 a.m. Pacific Time (“PT”) and ends on September 30 at 11:59:59 p.m. PT (the “Contest Period”).

3. Eligibility: Participation in the Contest is open only to legal residents of the 50 United States and the District of Columbia (“D.C.”) who are eighteen (18) years of age or older (19 or older if a resident of Alabama or Nebraska).

The following persons are NOT eligible to participate: Employees, officers and directors of Sponsor, the its parent company, affiliates, subsidiaries, advertising and promotion agencies, anyone involved in the creation, execution or fulfillment of this Contest, and members of the immediate families (defined as spouse, biological, adoptive and step-parents, grandparents, children, grandchildren, siblings, and their respective spouses, regardless of where they reside) and/or households (whether related or not) of any of the above.

The Contest is void outside the 50 United States/D.C. and where prohibited.

4. How To Enter: To enter, submit your original Design, along with your full name, complete postal mailing address, date of birth and telephone number by email to: tshirts@bleacherreport.com. Please note: your original Design must meet all of the “Design Requirements” (as set forth in Rule 6, below) and “Content Restrictions” (as set forth in Rule 7, below).

5. General Entry Information/Conditions:

(a) All entries must be received by 11:59:59 p.m. PT on September 30.

(b) Once your entry is received in accordance with these Official Rules, you will be entered into the Contest and deemed a “Participant”, and the Design you submitted may be posted on Sponsor’s web site or on social media for viewing by the general public, in Sponsor’s discretion.

(c) Limit one (1) entry per person for the entire Contest Period. Multiple submissions of the same entry by the same Participant or by members of the Participant’s household or by anyone other than the original Participant will be disqualified.

(d) There may be only one (1) named Participant for each entry submitted, regardless of the number of persons who may have contributed to the creation of the entry.

(e) Sponsor reserves the right to review and void any entry if Sponsor feels, in its sole discretion, such entry does not comply with these Official Rules or that the entry would be considered to be offensive to the viewing public or damaging to the Sponsor in any way. Sponsor may so void any entry either before or after it is posted on the Sponsor’s web site or social media pages.

(f) By submitting a Design, each Participant hereby represents and warrants:

(i) That the Design is the Participant’s original creation, unpublished, and not previously submitted in any other contest. Modifying, enhancing or altering a third party’s preexisting work does not qualify as a Participant’s original creation.

(ii) that s/he agrees to grant certain rights s/he may have in the Design to Sponsor, its affiliates and agents (as described in detail in Rule 8, below), and forever releases and holds Sponsor harmless from and against any liability of any kind arising from or in connection with Sponsor or its agents’ use of the Design; and

(iii) that Participant agrees to abide by and be bound by these Official Rules and the decisions of the Sponsor, which shall be final and binding in all matters relating to this Contest.

(g) Sponsor reserves the right not to post or accept any entry in its sole discretion.

(h) By participating in this Contest, each Participant agrees that Participant’s entry is gratuitous, unsolicited and without restriction, and will not place Sponsor under any obligations other than those contained in these Official Rules, and that Sponsor is free to disclose the ideas contained in the Participant’s entry on a non-confidential basis to anyone or otherwise use the ideas in accordance with these Official Rules without any compensation to Participant. Participant further acknowledges that, by acceptance of his/her entry, Sponsor does not waive any rights to use similar or related ideas previously known to Sponsor, or developed by its employees, or obtained from sources other than Participant.

(i) By participating in this Contest, each Participant hereby warrants and represents that s/he has not included any restricted content (see list of Content Restrictions in Rule 7, below) in his/her entry and has not violated any of the Design Requirements (see list of such Requirements in Rule 6, below) with respect to his/her entry.

(j) The Web Site’s clock is the official timekeeper for purposes of this Contest.

(k) Proof of submission of an entry will not be deemed proof of actual receipt of entry by Sponsor.

(l) Participants will not now or in the future be paid or compensated in any way for their entries or for granting the Sponsor any of the rights set out in these Official Rules.

(m) Sponsor is not obligated to make use of any of the rights granted in these Official Rules.

(n) Entries will not be returned or acknowledged except as provided herein.

6.  Design Requirements:

(a) No Infringement: The Design must not infringe third party rights by including, for example, the copyrights, trademarks, logos or products (such as company names, labels or symbols) music lyrics, photographs, works of art, or images that have been created, distributed, aired or published by others, such as those on or in websites, television, movies, or other media outlets. The Design may not refer to public figures, contain materials embodying the names, likenesses, photographs or other identifying elements of any person, living, or dead, without appropriate prior permission;

(b) Participants are solely responsible for Internet connectivity, software and/or hardware that may be required in order to create and/or submit any entry; and

(c) Design may not exceed a file size larger than 3 MB, and must be submitted in one of the following formats: [JPEG, PNG, AI, JPG, EPS  PDF].

7. Content Restrictions: Entry cannot: (a) be sexually explicit or suggestive, violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic, contain or reference nudity or any materially dangerous activity; (b) promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, or any particular political agenda or message; (c) be obscene or offensive, endorse any form of hate or hate group; (d) contain or reference trademarks, logos or trade dress owned by others, or advertise or promote any brand or product of any kind, without permission, or contain any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses; (e) contain copyrighted materials owned by others without permission; or (f) contain materials embodying the names, likenesses, photographs, or other indicia identifying any person, living or dead, without permission.

If a Design includes any of the prohibited elements listed above, the entry will be disqualified, along with the Participant who submitted it.

8. Rights Granted to Sponsor:

(a) By submitting a Design, each Participant grants Sponsor and its affiliates and agents a non-exclusive, sub-licensable, royalty-free, fully paid, unlimited, worldwide, license and right, without limitation or further permission or compensation, to reproduce, publish, display, edit, adapt, modify, distribute, develop, make derivative works from and otherwise use the Design in whole or in part for any commercial or non-commercial purposes in any manner and in any medium now known or hereafter devised throughout the world in perpetuity.

(b) Each Participant agrees not to instigate, support, maintain or authorize any action, or lawsuit against Sponsor or its affiliates or agents on the ground that any use of Participant’s Design infringes any of his/her rights as creator of such Design.

(c) By submitting a Design, each Participant grants Sponsor and its affiliates and agents the right, without limitation, compensation or further notice or permission, to use and publish the Participant’s name and likeness for promotional, advertising, publicity and marketing purposes in any manner, in commerce and in any medium now known or hereafter devised, throughout the world in perpetuity.

(d) Sponsor may require any Participant to execute documents to confirm the grant of rights hereunder; failure to do so may result in disqualification.

9. Winner Determination: The Grand Prize winner and Runners-Up will be determined in a two-phase process, as follows:

Phase 1 – Judging:  All eligible entries will be judged by qualified judges on the basis of Creativity (25%%), Demonstration of school spirit (25%), Originality (25%)and Wearability (25%). The 20 Participants whose entries receive the highest overall scores from the judges will be deemed Finalists, and will proceed to Phase 2 of the winner selection process. In the event of a tie, the tied Participant with the highest score in Demonstration of school spirit will be deemed the Finalist. The judging is scheduled to conclude on or about October 1st].

Phase 2 – Public Voting: Following the conclusion of Phase 1, the Finalists’ entries will be posted on the Sponsor’s Fan Page at facebook.com/bleacherreport. Beginning on or about [October 1st] at [10:00pm PT], and ending October 12 at 11:59pm PT (the “Voting Period”), eligible members of the general public (“Eligible Voters”), as defined below may vote for their favorite entry/ies by first “Liking” the Sponsor’s Fan Page (if they haven’t done so already), and then following the instructions and prompts to access the Contest application. Once on the application, Eligible Voters may place votes in accordance with these Official Rules and any instructions that may be posted on the application.

On each day of the Voting Period, Eligible Voters may vote for as many different entries as they wish; however, they may not vote for any individual entry more than one (1) time in a single day.  Voting is subject to these Official Rules, all applicable terms of use of the social media site, and any voting instructions that are posted thereon. In order to be an Eligible Voter, you must be: a legal resident of one of the 50 United States or D.C.; and 18 years of age or older at the time you vote (19 or older if a resident of Alabama or Nebraska). Finalists in the Contest are permitted to vote for their own entries or any other entry subject to the conditions and limitations stated herein.

Any Finalist or Eligible Voter offering, using, or attempting to use a “cheat,” payment, or other incentive, or any other improper means to obtain votes or affect the outcome of the Contest will be disqualified and any votes earned by those means will be void, in Sponsor’s sole discretion.  If any attempt is made to vote in excess of the stated daily limit or to obtain a vote by means other than as specifically set forth in these Official Rules or on the social media site, Sponsor may, in its sole discretion, disqualify any related Finalist, Eligble Voter, entry or vote. Use of any automated, script, software, macro or robotic program or any other automated or improper means to submit or gain votes may result in the disqualification, in the sole discretion of the Sponsor, of any related Finalist, Eligble Voter, entry or vote.

Votes that do not comply in all respects with these Official Rules, or that result from fraud or collusion (in the opinion of the Sponsor) will be disqualified and rendered void. If a Finalist is found to have engaged in such fraud or collusion, in Sponsor’s opinion, s/he will be disqualified from the Contest and will not be eligible to win the prize.

Other reasons for which votes may be declared void include but are not limited to the following:

(i) multiple votes are received from the same Voter for the same individual  entry in a single day,  from different IP addresses or from different email addresses;

(ii) votes result from use of a redirect link, a disguised link, a fraudulent link, or similar impermissible method;

(iii) votes result from a technical malfunction of servers or internet connection; and/or

(iv) votes result from inappropriate action by a voter or Finalist in promoting such votes from others (e.g., through spam, harassment, etc.).

Following the conclusion of the Voting Period, all votes received for each Finalist’s entry will be counted. The Finalist whose entry received the highest number of valid votes will be deemed the Grand Prize winner (subject to verification), and the three (3) Finalists whose entries received the next-highest number of valid votes will be deemed the Runners-Up (subject to verification.

In the event of a tie, i.e., exactly the same number of valid votes, the tied Finalists will be entered into a random drawing through which one (1) such Finalist will be selected to be the Grand Prize winner.

The potential Grand Prize winner and Runners-Up will be determined on or about October 14th. The potential winner, Runners-Up and each of their respective entries are subject to validation and verification of eligibility and compliance with all terms and conditions set forth in these Official Rules as a condition of be awarded the applicable prize described in Rule 10, below.

10. Grand Prize: One (1) Grand Prize will be awarded, consisting of  two-hundred-fifty (250) t-shirts printed with the winning design, which winner may distribute free of charge at his/her school. Approximate Retail Value (“ARV) of Grand Prize: $2,500.

Runner-Up Prizes: Each Runner-Up winner’s Design will be printed on t-shirts that will be made available for purchase at the Bleacher Report online store through approximately 10/1/2013.

11. General Prize Conditions: The prizes consist only of the items described above. Prizes are non-transferable. No prize substitutions or cash redemptions allowed, in whole or in part, except as provided herein. Sponsor reserves the right to substitute a prize of equal or greater value if an advertised prize becomes unavailable.

Grand Prize winner will be responsible for payment of all federal, state and local income taxes on his/her prize. Any difference between the stated ARV and the actual value of the Grand Prize, if any, will not be awarded.

12. Winner/Runner-Up Notification/Prize Claim: On or about October 15th, the Sponsor will notify the potential Grand Prize winner and Runners-Up by email, telephone and/or postal mail. Each such potential winner/Runner-Up will be required to sign and properly execute an affidavit of eligibility, liability release, publicity release (where permitted by law) and an assignment of rights consistent with these Official Rules, and return all required documents within seven (7) days of first written notification.

If any prize is not claimed in accordance with these Official Rules or if any prize notification or documentation is returned as undeliverable, or if winner or any Runner-Up refuses to accept his/her prize, or if the potential winner or any Runner-Up is deemed ineligible for any reason, the corresponding prize will be forfeited. If the Grand Prize is forfeited, it will be awarded to the Runner-Up who received the next-highest number of valid votes during the Voting Period. If any Runner-Up prize is forfeited, it will be awarded to the Finalist who received the next-highest number of valid votes during the Voting Period.

13.General: Each Participant assumes all risk of loss, damage, destruction, delay or misdirection of the entry submitted to Sponsor.

By participating in this Contest, each Participant agrees to indemnify, release, defend and hold harmless the Sponsor, Facebook, Inc., their respective agents, parent companies, affiliates and subsidiaries, and the officers, directors, and employees of each of the foregoing, from and against any and all liability for injuries, losses, or damages of any kind to persons or property, including without limitation death, arising from or in connection with participation in the Contest or the acceptance, possession and/or use/misuse of a prize (if awarded to him/her). Each winner, by accepting a prize, acknowledges that Sponsor has neither made nor is in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to such prize, including, but not limited to its quality, mechanical condition or fitness for a particular purpose.

The Sponsor is not responsible for: (i) electronic transmissions or entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, misdirected, or not received by Sponsor or its agents for any reason; (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries, or for destruction of or unauthorized access to, or alteration of, entries; (iii) failed or unavailable hardware, network or, software; (iv) causes beyond Sponsor’s reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Contest; (v) incorrect or inaccurate entry information whether caused by Participants or by any of the equipment or programming associated with or utilized in the Contest; (vi) any typographical or other error in any printing or advertising related to the Contest, in the administration or execution of the Contest, or in the announcement of the Finalists  or Grand Prize winner; or (vii) cheating or fraud by any Participant or Voter. All incomplete or non-conforming entries will be disqualified.

If for any reason this Contest cannot be executed as planned, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor that corrupt or affect the security, administration, fairness, integrity or proper conduct of this Contest, or if this Contest is compromised or becomes technically corrupted in any way, electronically or otherwise, Sponsor reserves the right to terminate this Contest. If this Contest is terminated before the original end date, the judges will evaluate the eligible, non-suspect entries received by the time/date of termination on the basis of the judging criteria set forth herein. The Participant whose entry receives the highest score will be deemed the Grand Prize winner and the three (3) Participants whose entries receive the next-highest scores will be deemed the Runners-Up. Sponsor reserves the right, at its sole discretion, to disqualify and prosecute any individual who tampers with or attempts to tamper with the entry process or any aspect of this Contest. CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR FAN PAGE OR OTHERWISE CORRUPT OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS.  SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY, PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

By accepting a prize, each winner agrees that Sponsor may use the winner’s name, likeness, photograph and/or limited biographical information for promotional purposes, in commerce and in any media worldwide without limitation and without further consideration, payment or notice.

By participating, Participants agree that (a) any and all disputes, claims and causes of action arising out of, or connected with, this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate state or federal court located in the State of California; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including but not limited to costs associated with entering this Contest but in no event attorneys’ fees; and (c) to the extent allowed by applicable law, under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental and/or consequential damages and/or any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Participants’ rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of California, without giving effect to any choice of law or conflict of law rules (whether of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than California.

The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Contest-related materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern and control.

14. Winners List:  For the names of the Grand Prize and Runner-Up prize winners, send a self-addressed stamped business-size envelope to: T-Shirt Design Contest Winners List, 153 Kearny St, 2nd Floor, San Francisco, CA 94108. All requests must be received by November 15, 2012.

15. Sponsor: This Sweepstakes is sponsored solely by Bleacher Report, San Francisco, CA.

Any questions, comments or complaints regarding this Promotion must be directed to the Sponsor only, and NOT to Facebook.

Team Stream, On a Billboard

Today we’re unveiling Bleacher Report Team Stream billboards in seven cities around the US.

These are the first ever interactive billboards that display news about your favorite team.  First, they display real-time headlines for the teams that are closest to the billboard. And second, they are interactive. Just tweet a team name to the address on the billboard and we’ll change things up.

So for example, if you want to put Packers headlines on the billboards in Chicago, all you’d have to do is tweet “Green Bay Packers” to @TeamStreamChi (but watch out, eh).
