I would like to plead to you to read thoroughly in hopes that an answer to my prayers of a mothers broken heart may be within your hands or guidance. I’m a single mother of two wonderful children that have always been under my care and protection since the day they have been born. I had my daughter, Sophia, in 2001 when I was young and made mistakes along the way like any new parent has. Behind every one of my decisions and actions always best intentions and wishes for my child in mind. After a failed reconciliation with the father of my children I had my son, David, in 2005. My name is Karla Ruby Del Huerto and I’m fighting to keep my children in a corrupt judicial system in Webb County. I put forth this letter to explain my situation and let it be heard outside of Judge Jesus ‘Chuy’ Garza’s court room. It all started over the summer, my children visited with my family in Laredo Texas while I stayed in San Antonio to work. The custody order that was in place at the time stated that my children where to visit for the month of July with their father. (You must know that he has an unset work schedule since he works for the fire department and visitations have never been enforced by him.) This summer he did not take possession of our children during the summer or the month of July. He ended taking the kids after enrolling them in Webb county schools and serving me with a custody suit claiming I abandoned my children. Never did I do that, I was always in touch, provided money, summer activities, and a smart phone so we could video chat or stay in contact at all times. The key evidence that is being used against me is a signed Power of Attorney that my sister possessed giving her limited power over medical and urgent care. This POA was limited and could be revoked by me at any time. Never did it state or indicate that I was abandoning my children or parental rights. This case rightfully belongs in Bexar County, for my children and I are legal residents of San Antonio. Several credible attorneys have confirmed this but Honorable Judge Garza denied the transfer of the case to Bexar County without just cause. I have filled a Mandamus with the Fourth Court of Appeals in Austin Texas, yet no answer to my pleading. The holidays are here and I don’t have much time to misuse, the final hearing is set for January 15th, 2013 in Webb County. If the case stays in Judge Garza’s court room it is almost a certainty that I am losing my babies. As of now Judge Garza gave temporary possession of my children to their father who has hardly ever cared for them. I’m the only one who has been there for every fever; scrape of the knee, school recital, award ceremony and many other ‘first’ accomplishments in my children’s lives. The court appointed an attorney f or my children and she stated to the court that she did not find a reason as to why the children were taken from me. She also stated that she had no evidence to think that my children ever were in danger or neglected under my care, now or ever. Despite all this I still have no say or worse I don’t have my babies with me. We have been ripped out of our life living out of suitcases, lost my job, forced to stay in Laredo and leave our home in San Antonio. I just purchased my house last holiday season to provide my babies with a place to grow up making memorable memories in comfort. I’m not asking for sympathy, just for the justice that my family rightfully deserves. “The fight for justice against corruption is never easy. It never has been and never will be.
