H.R. 5932 is expected to be considered on the House floor on Wednesday, September 22, 2010, under a suspension of the rules, requiring a two-thirds majority vote for passage. This legislation was introduced by Rep. Bobby Scott (D-VA) on July 29, 2010, and referred to the Committee on the Judiciary, which took no official action.
H.R. 5932 would authorize the Attorney General to establish the Organized Retail Theft Investigation and Prosecution Unit (ORTIP Unit) to investigate and prosecute those instances of organized retail theft; assist state and local law enforcement agencies in investigating and prosecuting organized retail theft; and to consult with and advice victims of organized retail theft.
The bill defines “organized retail theft” as the act of obtaining retail merchandise by illegal means for the purpose of reselling or otherwise placing such merchandise back into the stream of commerce; or aiding or abetting the commission of or conspiring to such acts.
The bill would require the Attorney General to submit a report to the House Committee on the Judiciary within a year of the date of enactment. Lastly, the bill would authorize the appropriation of $5 million for each of fiscal year from 2011 through 2015.
