Federal Judge Rules ObamaCare is Unconstitutional


Washington, Dec 17, 2010 - On Monday, U.S. District Court Judge Henry Hudson of the Eastern District of Virginia declared the Democrats’ health care law to be unconstitutional.  Under the overreaching health care law, Democrats have loosely used the Commerce Clause to require every individual to purchase health insurance that they do not want, do not need, or cannot afford.  Monday’s ruling found, however, that “neither the Supreme Court nor any federal circuit court of appeals has extended Commerce Clause powers to compel an individual to involuntarily enter the stream of commerce by purchasing a commodity in the private market.”  Congressman Miller applauds this win for freedom and believes firmly the health care law exceeds constitutional boundaries of congressional power.  In the next Congress, Congressman Miller will continue his fight to repeal the health care law and replace it with real solutions that drive down the cost of health care.
