WASHINGTON, D.C. (June 7) -- The U.S. Consumer Product Safety Commission (CPSC) today announced that Judge S. Hugh Dillin, of the U.S. District Court for the Southern District of Indiana, has issued a temporary restraining order against Ayr-Way Stores Inc., a mid-west retail chain based in Indianapolis, Indiana enjoining them from further sale of children's wearing apparel which contains the flame retardant chemical TRIS.
The injunction was issued after a suit was filed by CPSC alleging that Ayr-Way stores in the Indianapolis, Indiana; Louisville, Kentucky; and Cincinnati, Ohio market areas were selling TRIS-treated apparel as recently as Monday, June 6, 1977.
On April 8, 1977 the Commission banned the sale of children's wearing apparel made from fabrics treated with TRIS. The Commission's order indicates that it is based upon studies showing TRIS to be a potential carcinogen in humans. A hearing on the motion for a preliminary injunction has been set for June 17 in Indianapolis.
