Terms and Conditions For Complimentary Trial Access to the National Technical Reports Library

  1. Scope: The National Technical Information Service (NTIS) hereby grants Subscriber a non-exclusive, nontransferable right to make the National Technical Reports Library (NTRL) available to Subscriber’s Authorized Users for Authorized Purposes.
  2. Authorized Users: Authorized Users are natural persons who are Subscriber’s bona fide employees, students, walk-in patrons, or agents but only if they agree to use the NTRL for Authorized Purposes.
  3. Authorized Purposes: Authorized Purposes are limited to search, retrieval, display and downloading of NTRL data through Subscriber’s computer system. Sale of NTRL data or copying all or a portion of NTRL data for the purpose of replacing it are NOT Authorized Purposes.
  4. Security: Subscriber understands that any attempt by any person to gain unauthorized access to a Government Web site through access to the NTRL from Subscriber’s location will result in Subscriber’s immediate loss of access and may result in civil or criminal prosecution of the person attempting such access. Subscriber will take appropriate action to ensure that persons gaining access to the NTRL are aware of their potential civil and criminal liability for attempting to gain unauthorized access to U.S. Government Web sites.
  5. Third Party Usage: Nothing in these Terms and Conditions authorizes Subscriber to sublicense the NTRL to another party, to make it available via a gateway, or to otherwise make it available to users who are outside the organization subscribing to the NTRL.
  6. Copyright: Although information produced by federal agencies is generally not copyrightable, federal reports often contain copyrighted material used by permission of the copyright owners. NTIS makes no representation about the copyright status of any technical reports in its collection, or portions thereof. Authorized Users are responsible for securing appropriate permission or ascertaining whether “fair use” of the material is allowed (see http://cendi.dtic.mil/publications/00-3copyright.html).
  7. Liability: The United States Government (a) makes no warranty, express or implied, with respect to information provided under this agreement, including, but not limited to, implied warranties of merchantability and fitness for any particular use; (b) assumes no liability for any direct, indirect or consequential damages flowing from any use of any part of the NTRL; (c) assumes no liability for any errors or omissions in NTRL data.
  8. Period: Unless replaced by NTIS, this Agreement shall remain in place as long as the Subscription remains current.
  9. Disputes: This Agreement will be governed by applicable Federal law as interpreted by the United States Court of Federal Claims.
