The Privacy Act of 1974, as amended (Privacy Act), as implemented within the Department of Defense (DoD) by DoD 5400.11-R, applies to each system of records maintained by a DoD Component. A “system of records” is a group of records containing an individual’s personally identifiable information (PII) maintained by a DoD Component and from which the individual’s PII is retrieved by information unique to the individual. When a DoD Component solicits and collects PII but does not maintain it in a system of records, a Privacy Act Statement is not required. However, because PII is collected, the TMA Privacy and Civil Liberties Office uses a special notice type referred to as a “Privacy Advisory.” The purpose of a Privacy Advisory is to inform individuals why their PII is being solicited and collected, and how it will be maintained and used in lieu of being stored in, or retrieved from, a system of records.
