Visa Waiver Program
Arriving at U.S. Land Borders - Form I-94W
Arriving by air and sea – ESTA

(08/10/2011)
A completed Form I-94W, Nonimmigrant Visa Waiver Arrival/Departure Record (green form), is required from all Visa Waiver Program (VWP) visitors to the United States at land ports of entry. Each VWP applicant for admission is exempt from a visitor’s visa (B1/B2) if he or she is a citizen of any of the VWP countries. (
VWP FAQs ) . Currently, authorization for travel under the VWP via the Electronic System for Travel Authorization (ESTA) is not required if arriving at a U.S. land port of entry.

Form I-94W ( I-94W ) contains questions that assist with determining admissibility to the United States. The VWP traveler’s signature is required on Form I-94W that waives the right of review of an inadmissibility determination by an Immigration Judge. If an intending traveler has any doubt about whether he will be admissible to the United States without a visa, he should contact the closest U.S. Embassy or Consulate to obtain a nonimmigrant visa prior to travel.

Upon arrival, the VWP applicant for admission will complete Form I-94W, including the admissibility questions. A U.S. Customs and Border Protection (CBP) officer will stamp the applicant’s completed Form I-94W, the passport and the CBP Customs declaration, and will return the passport to the traveler.

VWP travel authorization via ESTA is required if arriving by air or sea under the VWP. The ESTA application is available at ( ESTA ) . Authorization via ESTA provides CBP with the I-94W information electronically. In addition, the ESTA application requires the applicant to acknowledge the waiver of right of review. The electronic transmission of data and the electronic signature has enabled CBP to eliminate the paper Form I-94W for air and sea arrivals.

Further information on U.S. entry requirements may be found at the internet websites for U.S. Customs and Border Protection ( CBP ) , Department of Homeland Security ( DHS ) , the U.S. Department of State ( DoS ) , or through a travel agent.
