Freedom of Information (FOIA)

The Freedom of Information Act (FOIA) generally provides that any person has a right of access to federal agency records, except to the extent that such records are protected from disclosure by one of nine exemptions or by one of three special law enforcement record exclusions (see link to FOIA statute for detailed information on the nine exemptions and the exclusions).

It's EPA's policy to make the fullest possible disclosure of information without unjustifiable expense or unnecessary delay to any requestor. In most cases there will be a charge when more than one-half hour of work is devoted to locating, reviewing and copying records requested under FOIA. Generally, you have a right to a decision with regard to the release of the requested records within 20 working days of receipt of your inquiry.

To help the Agency process your request, please include: (A) your name, address, and phone number; (B) specific information describing the records you're seeking; and (C) a statement regarding whether payment of fees is guaranteed.

All requests made under the FOIA are a matter of public record and may be placed in the Agency’s public files.
