Treasury Offset Program is responsible for collecting delinquent claims from former recipients who received an overpayment of benefits which has not been repaid and for which there is no repayment agreement. Notification letters are mailed to responsible individuals informing them of the outstanding balance on the claim. The letter explains that the debt will be submitted to the Department of Treasury for withholding from their federal income tax refunds or other federal benefits received by the household unless:
  1. the claim is paid in full within sixty (60) days; or
  2. a satisfactory repayment agreement is reached.
The amount of the Food Stamp debt can be reduced by voluntary payments made prior to intercept of the tax refund or federal benefits. Recipients of the TOP notification are given an opportunity to provide evidence to reduce the amount of the debt or to show that the debt is not owed.
